Removal of a Criticality Monitoring System Docket No.: 50-5 NRC License: R-2
Dear Sir:
Section 70.24, " Criticality Accident Requirements," of 10 CFR, Part 70, " Domestic Licensing of Special Nuclear Material," requires that licensees who possess special nuclear materials (SNM) in a quantity exceeding 700 gs of contained uranium-235, shall maintain in each area in which such licensed SNM is stored a monitoring system meeting specified requirements. Previously there were 802 gs of U-235 in eight (8) partial MTR-type highly enriched fuel elements stored in a special pit of the Breazeale Nuclear Reactor. In May of 1982, one MTR fuel element containing 134 g U-235 was sent to the Los Alamos Laboratory in New Mexico. Penn State now has 668 gs of U-235 in seven partial MTR-type highly enriched fuel elements stored in the special pit. No other SNM is stored in this area.
The criticality monitoring system for this area has been removed because the SNM is less than 700 gs of contained U-235. In view of this action, please cancel our " Request for Exemption of a Criticality Monitoring System" as specified in Dr. R. G. Cunningham's letter to y>u, dated October 14, 1980.
