The session this morning is an affirmation and possible discussion session.

a moment, I will ask the Secretary to go through these items.

6 However, there is a desire on the part of the Commission to 7

add an additional item to the agenda.

It would take a vote 8

to hold it on less than one week's notice.

SECY-81-625, Final Rule on Intransit Physical Protection of Special Nuclear Material of Moderate Strategic Significance.

The first 17 paper is SECY-81-707, Dr. Taplin's petition regarding 18 10 CFR Part 35, " Human Uses of Byproduct Material" in which y

the Commission is being asked to approve a notice of proposed j

19 rulemaking which would grant in part the petition for l f rulemaking by Dr. Taplin for an exception from certain i

regulatory requirements' for the use of radioactive drugs.

The Chairman and Commissioners Ahearne and Roberts have approved Alternative 2 in the paper as ' modified by 24 Mr. Minogue's memorandum of February 24th.

The second paper is 82-74, Proposed 3

Rulemaking, " Codes and Standards", 10 CFR 50.55a where the 4

Commission is being asked to approve a notice of proposed g

rulemaking to modify codes and standards by referencing ASME 6

codes regarding construction of certain safety system compon-7 ents and by removing obsolete provisions.

8 All Commissioners have approved the paper agreeing 9

with Commissioner Ahearne's modifications.

10 Would you please affirm your votes?

COMMISSIONER ROBERTS:

Yes.

12 COMMISSIONER ROBERTS:

There is an absolute h

insulting statement in Enclosure 1, page 7, first full 14 sentence, and I quote, "These applicant companies will incur estimated costs of $15,000 when applying for ASME approval."

16 I can't believe this agency would make such a 8

17 statement.

It is absolutely without any basis in fact and j

I am extremely disappointed that Dircks would sign off on j

All we are doing is' bringing our procedures into what is practiced.

And Vickie has just pointed 14 out that the Regulatory Flexibility Act conclusion that is

The third item is SECY-82-82, Devine F0IA Appeal regarding the OIA Zimmer Report in which the to Commission is being asked to deny an appeal by Mr. Devine for access to four documents.

Ahearne have voted to, deny the appeal.
