This is in response to your letter of January 18,. ;2 in whic you requested a 6-month extension of time-until July 20,1982-to imphaentm? /

Your request is not sufficiently specific or complete for us to reach a determination in this matter. To dispose of your request, we will require additional infomation as follows:

a.

an identification of the specific reoutrements of the regulation for which a delay in implementation is requested, and b.

a detailed statement of the reasons for the delay in implementation of 10 CFR 73.21, and c.

a detailed description of compensatory measures to be employed during the delay period.

The information provided must be sufficiently complete so as to enable us to make the requisite findings of 10 CFR 73.5, " Specific exemptions," since your request for an " extension" is, in fact, a request for an exemption from Section 73.21.

Since exemptions form the regulations cannot be obtained by the unilateral action of a licensee, you are not currently exempted from compliance with 10 CFR 73.21.

The information requested in this letter affects fewer than ten respondents; therefore OMB clearance is not required under P.I.96-511 Sincerely.

This is in response to your letter of January 18, 1982 in which you requested a 6-month extension of time-until July 20, 1982-to implement all aspects of 10 CFR 73.?1, " Requirements for the protection of safeguards information."

Your request is not sufficiently specific or complete for us to reach a i

determination in this matter. To dispose of your request, we will require additional information as foUows:

a detailed statement of the reasons for the delay in implementation of 10 CFR 73.21, and c.

a detailed description of compensatory measures to be employed during the delay period.

The information provided must be sufficiently complete so as to enable us to make the requisite findings of 10 CFR 73.51, " Specific exemptions " since your request for an " extension" is, in fast, a request for an exemption from Section 73.21.

Exemptions from the regulations cannot be obtained by the unilateral action of the licensee as you suggest in the closing paragraph of your letter of January 18, 1982. You should noteethat the new 10 CFR 73.21 was published in the Federal Register on October 22, 1981 with an effective date of January 20, 1982. Your letter requesting relief was dated,just two days before the effective date of the new rule and was not received by the NRC in a time period that would allow any action on your request before the c effective date of the new rule. Thus, you are not currently exempted from compliance with 10 CFR 73.21.
