In accordance with your application dated December 27, 1979, and supplements dated December 4,1981, March 8,1982 and March 30, 1982, and pursuant to Title 10, Code of Federal Regulations, Part 70, Materials License No. SNM-1097 is hereby amended to authorize use of the new incinerator. Condition 9 of SNM-1097 is amended to include the dates of December 27, 1979, December 4, 1981, March 8,1982 and March 30, 1982. Authorization to use the incinerator is subject to the following conditions:

1.

The safe mass limit for the incinerator shall be based on the maximum enrichment measured in all boxes processed during a burn cycle.

Notwithstanding the response to NRC question 15b in your l

1etter of March 8,1982, during the first 30 operating l

days (incineratifon, ash removal, and contaminated maintenance),anysingleairsamplewhichexceedsthe applicable concentration in Appendix B, Table 1,10 CFR 20 shall be investigated by the Radiation Safety function.

Notwithstanding the responses to NRC questions 15c(1) and (ii) in yourrietter of March 8,1982, during the first 30 operational days, surveys for surface contamination shall be made daily. The cleanup operation shall be conducted as soon as possible (at lesst within 48 hours5.555556e-4 days <br />0.0133 hours <br />7.936508e-5 weeks <br />1.8264e-5 months <br />) l when the contamination exceeds 5000 dpm alpha per 100 cm2 (removable).

If thg 30-day facility average is less than 5000 dpm per 100 cm', the survey frequency may be changed to weekly.

General Electric Company APRI 3togg Pending resolution of the combined Environmental Impact Assessment (EIA) for the UF6 to UO2 production tapacity expansion and the new incinerator facility, Amendment No. 21 to SHM-1097, dated September 30, 1981, limited plant through-put to a maximum 1500 metric tons of U02 in a 12-month period. With the completion of the EIA in April 1982, and issuance of the Negative Declaration on April 8,1982, the throughput restriction in Amendment No. 21 to St#1-1097 is hereby rescinded. All other conditions of this license shall remain the same.

The above license conditions were discussed and agreed to by your Mr. Vaughan and Mr. Bidinger of my staff on March 31, 1982.
