Dear Members of the Board:

I recently received a copy of your statement in support of the Attorney General's request for a hearing on the Order Modifying License that was issued by the Director of the NRC's Office of Inspection and Enforcement. The Director's order required Boston Edison Company to submit and implement a plan to improve its control of its operation of the Pilgrim Nuclear Power Station.

As you may know, the NRC staff has opposed the Attorney General's request.

Our opposition is based primarily on the fact that Boston Edison Company has consented to the order and the Attorney General does not contest the imposition of the order. Thus, in the staff's view, a hearing on the Director's order is unnecessary, since all are agreed that Boston Edison should comply with the order. Copies of the staff's recent filings with the Comission are enclosed and more fully explain our views. Although the staff has taken this position, the decision to grant the Attorney General's request will be decided by the Comissioners themselves.
