NRC STAFF MOTION TO SEPARATE APPLICANT AND STAFF WITNESS PANELS ON S0C CONTENTION 16 The NRC Staff requests that the Board separate the Applicant and Staff witness panels on S0C Contention 16, related to clad swelling and flow blockage. The specific circumstances of this contention, rather than general objections, lead the Staff to request the separate panels.
As indicated in the prefiled testimony, both the Applicant and Staff oppose the assertions of the contention, but for different reasons.
Specifically, the Staff relies on a license condition requiring the Applicant to perfor$ an ECCS reanalysis for Shoreham's second cycle and beyond. The Applicant has taken the position that the reanalysis, and thus the license condition, is unnecessary. These distinctly different positions, in the opinion of the NRC Staff, justify separate witness panels for litigation of the issue.
