NRC RESPONSE TO WEST BRANCH CONSERVATION ASSOCIATIONS SECOND SET OF INTERROGATORIES TO STAFF Pursuant to 10 C.F.R. % 2.740b and the Board's Order of April 23, 1982, the Staff hereby submits its response to West Branch Conservation Associations Second Set of Interrogatories to Staff dated May 15, 1982 Q.WBCA-4.4-12 If a hospital has been advised to shelter its patients rather than move them, and a radioactive plume has passed over it, who will take over the clean-up, the monitoring and the responsibility of aiding the occupants of a State hospital?

The Rockland County Radiological Emergency Preparedness Plan (RERP), which is an annex to the State RERP, states, "The Selective Response Operation gives the County Chairman of the

action for individuals who could not be safely evacuated if a Selective or General Evacuation was necessary." The plan identifies these facilities:

y Hospital in West Haverstraw, the Rockland County Health Center in Pomona, and the Latchworth Village Development Center in

Thiells, the "Special Facility Procedure" of the plan discusses the details of implememtation (

Section III. H.4, Rockland County RERP).

Guidelines for recovery or clean-up operations are contained in Part I,Section IV, New York State RERP, the County Comissioner or Health in consultation with the New York State Department of Health is responsible for implementing recovery operations. "The Administrators of Rockland County's Special Facilities, based upon their institution's resources, will provide health care, shelter, food and aid in obtaining information and if necessary, transportation to their residents during radiological emergency operation." The State plan states " State and Federal assistance can be made available to assist affected counties in recovering from the affects of a radiological emergency for an affected area he may direct any and all agencies of the State government to provide assistence under the Coordination of the DPC."

Q. WBCA-4.4-13 The removal of the sick and incapacitated in State hospitals by other than State personnel requires letters of agreement. Are there any such for Rockland Psychiatric Hospital or Helen Hayes Rehabilitation Hospital?

l FEMA Response Baseo on conversations with officials of the New York State Department of Health we have been informed that each State hospital must have an approved evacuation plan prior to receiving accredita tion. Each hospital's evacuation plan addresses the orderly and

t safe removal of all hospital patients. Logistical arrangements for transport of patients are addressed in these hospital plans, in coopera' tion with supporting hospitals. FEMA is advised that arrangements obviate the need for 1etters of agreement.

Rockland Psychiatric Hospital is outside the Plume Exposure Pathway Emergency Planning Zone and therefore is not addressed in the Rockland County RERP.

Q. WBCA-4.4-14 Critics of the RERP hsave stated that the RERP for a General Emergency as described in Appendix of NUREG-0654, has written into it a necessity to make triage type decisions as to who receises consideration for safety and in what order. Please comment on the ability of the Plan to assure the safety of all citizens of Rockland County with equal opportunities for their safety and protection.

FEMA Response Based on discussion with officials from the New York State Department of Health, FEMA staff was advised that the County Commissioner of Health is responsible for triage procedures and triage assessment.

FEMA has no basis to gaestion the professional medical judgement of health officials in providing for the health and safety of county residents.

Q. WBCA-4.4-15 Considering the breakdowns in communications in Rockland

County and the lack of suitable equipment as described in FEMA's evaluation draft of the March 3 drill, when do you expect remedies to those defects? Who will pay for them? How will people unable to move themselves be assured their safety can be served in Rockland County?

FEMA Response In the near future, FEMA plans to forward the Post Exercise Assessment report to the Chairman of the New York State Disaster

Preparedness Comission and in the letter of transmittal will ask for a schedule of corrective action to be provided to FEMA within twenty-fiv'e days of receipt of that letter.

According to New York State Department of Health officials funds as authorized by Chapter 708, New York State Executive Law, will be appropriated by the State Legislature to all counties requiring RERP plans to the extent the funds will allow. Any expenses authorized for reimbursement in excess of funds appropriated will be considered unfinanced expenses and will be submitted for funding in supplemental funding requrests.

According to New York State Department of Health officials, Rockland County Department of Social Services, Department of Health and the Office of Aging have lists of mobility-impaired individuals.

These individuals will be provided assistance in accordance with the Rockland County RERP.

Q. WBCA-4.4-16 In what time frame might the citizens of Rockland County expect to have in place the type of evacuation plan as envisaged in NUREG-0654 and 50 C.F.R?

FEMA Response Each county RERP plan is either under revision or being rewritten.

Each plan will be submitted by New York State to FEMA for review and approval. The State of New York has not provided FEMA with a schedule of plan revisions to date.
