The NRC has recently revised its enforcement policy. This new policy was described in the Federal Register Notice (47 FR 9987) dated March 9,1982.
In accordance with this policy, the requirement that responses to all Notices of Violation be submitted under oath or affirmation is rescinded. Requiring sworn responses remains an NRC option which will be exercised in certain cases, including all cases involving escalated enforcement action.
Accordingly you will note that the Notice of Violation has been changed to eliminate the requin! ment for a sworn msponse in those cases where submission under oath or affimatinn is not deemed necessary. Where sworn responses must be submitted, the Notice of Violation will clearly indicate this. The guidance contained in our letter to you dated P4y 1,1981, should continue to be used as a format for sworn responses when required.
