The NRC has recently mvised its enforcement policy. This new policy was described in the Federal Register Notice (47 FR 9987) dated March 9,1982.
In accordance with this policy, the mquimment that msponses to all Notices of Violation be submitted under oath or affimation is rescinded. Requiring sworn responses remains an NRC option which will be exercised in certain cases, including all cases involving escalated enforcement action.
Accordingly you will note that the Notice of Vialation has been changed to eliminate the requirement for a sworn response in those cases when submission under oath or affirmation is not deemed necessary. Whem sworn responses must be submitted, the Notice of Violation will clearly indicate this. The guidance contained in our letter to you dated Me 1,1981, should continue to be used as a fomat for sworn responses when required.
