This refers to your letter dated November 3, 1981, and to an investigation conducted between May 1, 1980, and December 8, 1980, by the Region III investigation staff into allegations of irregularities in Tech-Sil's Quality Assurance / Quality Control Program, as related to the LaSalle Nuclear Power Station construction site.

Our investigation determined that Tech-Sil annagement personnel directed Tech-Sil employees to add quantities of previously rejected leaded gel material to its leaded elastomer product that was shipped to the LaSalle Nuclear Power Station. The addition of the gel material constituted a deviation from Quality Assurance / Quality Control procedures. It resulted in a product which did not meet the LaSalle Nuclear Power Station specifications for chemical content and was not fire tested. At the request of NRC, the conconforming asterial was fire tested and met minimum fire resistence specifications. Onr investigation also determined that the quality assuranca records and Certificates of Conformance which accompanied shipments of this asterial to the LaSalle construction site were false. A review of Tech-Sil Quality Assurance Department records showed false Certificates of Conformance were issued when the product was delivered to the LaSalle construction site.

l Since the NRC does not do one hundred percent verification of licensee or contractor work, it is essential that the integrity of lie===aam and contractors be above reproach.

,,, records are identified, we believe strong enforce==nt action is warrested. Accor:11agly, this ustter was considered for possible criminal prosecution. The issuance of an order by the NRC to prohibit further involvement by your company in the nuclear industry was also considered.

Bouever, after careful consideration of all aspects of this case, including that it occurred nearly two years ago, it was decided that these options would not be pursued. Although this office is not considering escalated enforcement actica for this case, further isproper settoes by your Company will undoubtedly result in enfore==ent action.

You will receive a letter and copy of the investigation report from our Region IV office concerning this matter med you will be requested to explain what action you have taken to correct and avoid recurrence of this unfortunate si*uation.
