This letter is written in response to your request dated April 15, 1982, for information regarding the renewal of Rockwell International's Special Nuclear Material (SNM) License flo. SNM-21 Docket No. 70-25. Answers to your questions are provided below:
(1) What is the procedure for renewing this license?
Response: The Nuclear Regulatory Comission (NRC) requires that applications for renewal of an SNM license be filed pursuant to Title 10, Code of Federal Regulations (10 CFR) Part 70.
If a renewal appli-cation is submitted not less than thirty days prior to expiration of the existing license, the license remains in effect pursuanttoSection70.33(b)ofPart70 until the application has been finally determined by the Commission.
In reviewing the application for renewal of an SN:1 license, the staff's principal concern is the past performance of the licensee. The main items reviewed are:
a) The licensee's history of compliance with the conditions of the license, including applicable NRC regulations.
b) The effluents from the facility l
(gaseous, liquid and solid) with f
respect to whether they have been as low as reasonably achievable.
c) The effect of these effluents on l
the public and the environment.

Is there a mechanism to provide a public hearing on the licensing?
Response
Yes; any person whose interest may be affected by an HRC licensing action and who desires to request a hearing may file a written petition for leave to intervene in accordance with the requirements of 10 CFR Part 2.714.
