PARTIAL RESCISSION OF ORDER I

The Consumers Power Company (the " licensee") holds Provisional Operating License No. DPR-20 which authorizes the operation of the Palisades Nuclear Power Facility at a steady state reactor core power level not in excess of 2530 megawatts thermal (rated power). The facility, a pressurized light water moderated and cooled reactor, is located at the licensee's site in Covert Township, Van Buren County, Michigan.

The Director's order confirmed the licens'ee's commitments to take certain actions to ensure safe operation of the Palisades facility. The Director's Order was effective upon issuance.

Although the licensee had made substantial commitments to implement long-term improvements in the licensee's control of licensed activities, it was important that these commitments be implemented without adversely impacting the safety of near-term operation. The staff was concerned that operators at the plant, who already appeared to be working excessive amounts of overtime, would be required to work increased overtime to pro-vide assistance in the development and implementation of the licensee's corrective measures.

The staff also foresaw that, if attrition of operators on staff continued to occur, additional burdens might be placed on the remaining licensed operators.

In response to the staff's concern, the licensee committed to adhere to the following restriction that was incor-porated in the March 1981 Order:

i III Since the Order was issued in March 1981, the licensee has substantially Implemented its actions to improve its control over operation of the Palisades facility. Thus, the concern for the potential adverse impact on operations as a consequence of the additional burden of developing and implementing the licensee's actions has been substantially ameliorated.

Therefore, adjustment of the March 1981 Order's work hour restrictions to the limits prescribed in the Commission's general policy on nuclear power plant staff working hours (47 Federal Register 7352) is appropriate.

The March 1981 Order explicitly authorizes the Administrator of Region III to make this type of change to the Order.

IV Accordingly, the provisions of'Section V.B.(1)-(3) of the Order Confirming Licensee Actions to Upgrade Facility Performance are revised as'follows:

"B.

Extended work hours on the part of licensed operators shall be avoided by restricting the work hours for licensed operators consistent with the following provisions:
