JOINT MOTION TO TERMINATE PROCEEDING The Staff and the Utility Workers Union of America, AFL-CIO, and the Michigan State Utility Workers Council (here-inafter the Union) hereby move that the Board terminate this proceeding.

On March 31, 1982, the Appeal Board remanded this matter to the Licensing Board for further proceedings consis-tent with the Appeal Board's decision to grant a discretionary hearing to the Union on the work hour restrictions imposed by the Director of the Office of Inspection and Enforcement's

" Order Confirming Licensee Actions to Upg'rade Facility Performance,"

46 Fed. Reg. 17688 (March 19, 1981).

ALAB-670, rev'g in part and remanding'LBP-81-26, 14 NRC 247 (1981).

The Licensing Board had previously denied the Union's request for a hearing both as a matter of right and of discretion in LBP-81-26.

On April 21, 1982, the Administrator of NRC Region III issued a " Partial Rescission of Order" (copy-attached) that adjusted the terms of the Director's Order of March 1981.

The revised restrictions are consistent with the Commission's policy statement on Nuclear Power Plant Staff Working Hours, 47 Fed. Reg.,7352 (Feb. 18, 1982).

In view of the Partial Rescission of Order, the Union hereby withdraws its request for hearing.

The matter being moot, the' Staff and the Union jointly move that the Board terminate this proceeding.

It is th'e parties' understanding that Consumers Power Company'does not oppose this Motion.
