This is to inform the Commission that a Notice of Violation and Propo~
Imposition of Civil Penalties in the amount of $16,000 will be issued to the Consumers Power Company on or about May 12, 1982. This action is~ based upon the licensee's failure at the Palisades Plant to maintain containment integrity during reactor startup, and for a failure to follow safety-related procedures during maintenance on a control rod drive mechanism.
Prior to initiating this action, meetings were conducted on March 31, 1982 at the Palisades facility arid concluded with a meeting between senior management personnel and the Director, IE, Regional Administrator, RIII, and other NRC staff members.
It should be noted that the licensee has not been specifically informed of the enforcement action. The schedule of issuance and notification is:
Action Signed May 7, 1982 Mailing of Notice May 12,1982 Telephone Notification of Licensee May 12, 1982 A news release has been prepared and will be issued about the time the licensee receives the Notice. The state of Michigan will be notified.
The licensee has 30 days from the date.of the Notice in which to respond.
Following NRC staff evaluation of the response, the civil penalties may be remitted, mitigated or imposed by Order.
