A special inspection was conducted by NRC Region II on December 29, 1981 at the Sequoyah facility to evaluate the regulatory significance of exceeding the control rod withdrawal limits during startup of Unit 2 on December 21, 1981. This event resulted in a Technical Specification limiting conditions for operation being exceeded for eight hours.
The direct cause of the event was a failure to include control rod withdrawal limits in appropriate procedures used for Unit 2 startup.
A contributing cause was the absence of training of the licensed operators with regard to the results of startup testing.
The violations identified as a result of the inspection are presented in the Notice of Violation enclosed as an Appendix to this letter.
The inspector's findings were discussed with Mr. C. C. Mason, Plant Superin-tendent on December 29, 1981.
NRC concerns relating to the violation were discussed between TVA representatives and NRC Region II staff members at an Enforcement Conference held in the Region II office in Atlanta on January 6, 1982.
In order to emphasize the need for the licensee to provide appropriate training and procedures to assure strict observance of Technical Specification limiting conditions for operation, we propose to impose civil penalties in the cumulative amount of Fifty Thousand Dollars for the items identified in the enclosed Notice of Violation and Proposed Imposition of Civil Penalties.
The violations have been categorized at the Severity Levels described in accordance with the Interim Enforcement Policy published in the Federal Register, 45 FR 66754 (October 7, 1980).
The base penalty of Forty Thousand Dollars was increased by twenty-five percent as provided by the policy because you could reasonably have been expected to have taken preventive measures to preclude.the occurrence since you experienced the same restrictions during the first thousand hours of Unit 1 operation.
You are required to respond to the Appendix and in preparing your response, you should follow the instructions specified in the Appendix.
In your reply, you should give particular attention to those actions you have taken or plan to take to achieve a significant improvement in your training program. a Tennessee Valley Authority allowed the condition to develop.
The shift technical advisor.(STA) performed the estimated critical calculation without considering rod withdrawal limits.
The' assistant shift engineer (ASE), who is also the Unit 2 senior reactor opera-tor, accepted the erroneous calculations without question.
The reactor operator (RO) at the controls had not stood shift at the Unit 2 controls for about eight months and had not been informed of the results of the Unit 2 physics tests or the special rod withdrawal limits in effect.
Your reply to this letter and the Appendix and the results of future inspections will tie considered in determining whether further enforcement action is appropriate.
In au:ordance with Section 2.790 of the NRC's " Rules of Practice," Part 2, Title 10, Code of Federal Regulations, a copy of this letter and the enclosure will be placed in the NRC Public Document Room.
The responses directed by this letter and the enclosures are not subject to the clearance procedures of the Office of Management and Budget as required by the Paperwork Reduction Act of 1980, PL 96-511.
