Dear Mr. Miller:
This will acknowledge receipt of your letter dated April 15, 1982 and the Nuclear Regulatory Commission's Invoice No. A0183 dated April 19, 1982 which is referred to in your letter.
Boston Edison Company, on behalf of itself and the co-appli-cants for a construction permit in the above-referenced docket, respectfully declines to pay the charges asserted in your letter on the grounds that such charges are without regulatory basis and for the other reasons asserted in the pending case of New England Power Company, et al vs. United States Nuclear Regulatory Commis-sion and United States of America, Docket No. 81-1839, United States Court of Appeals for the First Circuit.
In addition to and pending the outcome of said litigation, Boston Edison Company respectfully reserves its right to raise such other defenses, rights or claims as it might have with respect to this matter.
