In the early afternoon of April 8, 1982 the Board received Su fol County's Motion for Order Compelling NRC Staff to Produce Documents.

The transmittal letter from attorneys for Suffolk County stated that the parties had attempted to resolve the dispute which gave rise to this Motion and have been unable to do so; and that the~ Staff's refusal to produce the requested document was not final until the afternoon of April 7, 1982.

Because the document in question is stated by Suffolk County to relate to Contention 4, on which testimony is due to be filed on April 13, 1982, the County requested an expedited hearing (sic) on this Motion.

The letter also states that the Staff has agreed to the County's request for an ex-pedited resolution of the matter, and that the NRC Staff Counsel are avail-able by telephone.

Since Board Chairman Brenner was out of town on April 8,1982 and would not be available to other Board members for communication until April 13, 1982, I telephoned to Ms. Letsche (attorney for Suffolk County) and David Repka (attorney for the Staff) later in the afternoon of April 8,1982 to inform them that no action is now contemplated on this Motion until the Prehear-ing Conference scheduled for April 14, 1982.

Ms. Letsche indicated that this would cause the County hardship.

I indicated that when the Board considers the Motion it would also consider this factor and take whatever action it thought equitable at that time.
