In my April 7,1982 letter to you I enclosed a copy of an August 4,1981 i letter from Russell E. Dickenson, Director, National Park Service, Department of the Interior to Harold Denton, Director, Office of Nuclear r Reactor Regulation, NRC. Unfortunately, that letter had to be reproduced from microfiche and was blurred. I have located a clearer copy and had it reproduced for you and the other people on the Bailly service list. This is further resptmse to my letter of December 2,1980, to le John F. Ahearne, Chainnan, Nuclear Regulatory (tmnissian, regarding construction dewatering and the construction pennit extension for NIPSCO's Bailly Nuclear-1 and your response to that correspondence of Decmber 30, 1980. In answer to my request for infonnation regarding hearings on renewal of NIPSOD's construction pennit for ibilly Nuclear-1, you noted that the subject hearing had not been scheduled but that we would be kept informed. It is our present understanding that, while a specific date for the hearing has still not been scheduled, the NBC has eshhliched the date of August 28 as the last date for accepting depositions and intumgatories and that the hearing might be scheduled as ra:n as early October of this year. .o g l e l In your Ictter of Doomber 30, 1980, you noted that you had concluded that NIPSCD's revised dewatering plan constituted, "...a reavnable approach to the problcm of construction dewatcring..." and, in your letter of Noverrber 21, 1979, to NIPSCD, you noted "... that the existing monitoring and mitigaticn puwtau can detect and interdict any adverse conditions before they affect offsite features (except for pt -Mires for preventing and mitigating the effect of boils in the excavation)." We have recently requested and just Irv,nived a copy of the NBC Staff Evaluation of the Bailly Construction Permit Extension Request (July 17, 1981). 'Ihat evaluation concbriac that "On the basis of... our evaluation and mitigation swtau for construction dewatering... there will be no significant envirarinental impact... other than that already predictal and described...." 'Ihe evaluation further notes that the NBC will require nrrlification to the permittee's monitoring and mitigation swtwa to be subnitted for NBC review and approval prior to completing the construction permit extension hearing. As noted in former Secretary of Interior Andrus' letter to Omman Ahearne of October 3,1980, we are ccmcerned that the revised construc'h dewatering will result in water level rimlines at Oowles Bog National l Natural Landmark and that those water rimlines may not be able to be fully mitigated. 'Iherefore, we request that you supply us with all correspondence between NBC and NIPSCO since Dnerehar 30, 1980, regarding NIPSOD's proposed nonitoring and mitigation swtau for dewatering. We also ask that we be supplied with a copy of NIPSCO's nonitoring and mitigation ptwtan nodifications for review by the National Park Service and the U.S. Geologir-al Survey prior to empletion of the construction pennit extension hearings. _We ask that our review be conducted concurrent with the review by NBC and that any %=.su.s tnis Dm' t may have hwvi m th,e rmn,w m mncu- - m -r review prior to ConstIuction peDnit extension hearinas. ~ WmiT Of Our QX1tinuing interest in this notter, we ask that Sou include the tutimal Park Service on your Service (uniling) List for all matters related to Docket Na. 50-367 CPA.
