This is in response to your request.for commeh't1 dated March 4, 1982 concerning the Staff's Newmark Inquiry.
\\
I can only confirm the reviewers' conclusion that Dr. Newmark was never employed or retained by PGandE in any capacity on the Diablo Canyon Project.
He functioned solely as a con-sultant to the NRC Staff and played an important role in the development of the Diablo Canyon seismic criteria and design response spectra which PGandE was required to use in the Hosgri analysis.
This can be confirmed by examining pertinent portions of the record in this proceeding, such as Supplement No. 5 to the Staff's Safety Evaluation Report, page 3-1.
