Gentlemen:
This refers to the special inspection conducted on April 6, 1976, through April 9, 1976, by Messrs. D. Neely and J. Streeter of our Region I office in King of Prussia, Pennsylvania, of activities authorized by NRC License Nos. DPR-5 and DPR-26, and to the discussions held by Messrs. D. Neely and J. Streeter with Messrs. W. Stein, E. Kessig and other members of your staff on April 9, 1976. This also re'fers to the meeting held at the Region I Office on April 14, 1976, attended by Messrs. W. Cahill, E. Kessig and other me=bers of your staff with Mr. J. P. O'Reilly and other = embers of the Region I Office.
Thik special inspection of your health physics program was conducted as a result of the exposure to a worker on April 5, 1976, in excess of the quarterly limit set forth in 10 CFR 20.101'b). The inspection consisted of selective examinations of procedures ana representative records, inter-
-views with personnel, observations, and radiation measure =ents by the inspector.
Based on the results of this special inspection, it appears that several of your activities were not conducted in full compliance with NRC require-ments as set forth in the Notice of Violation, enclosed herewith as Appendix A.
As you are aware from the "Critaria for Determining Enforcement Action,"

Consolidated Edison Company JUN 21373 notices of violation, civil monetary penalties, and orders pertaining to the modification, suspension or revocation of a license. After careful.
evaluation of the items of noncompliance identified in Appendix A and the results of our special inspection, this office proposes to impose civil penalties, pursuant to Section 234 of the Atomic Energy Act of 1974, as amended, (42 USC 2282) and 10 CFR 2.205, in the cumulative amount of Twenty-Three Thousand Dollars ($23,000) as set forth in the " Notice of Proposed Imposition of Civil Penalties," enclosed herewith as Appendix B.
In addition to the need for corrective actions regarding the specific items of noncompliance listed in Appendix A, we are concerned about the implementation of your management control systems that permitted them to occur. Consequently, in your reply, you should describe those actions taken or planned to improve the effsetiveness of your management control' systems. In particular, we are interested in improvements you plan to better control activities in radiation and high radiation areas, and to improve com=unications among operating, maintenance and health physics organizations performing and controlling such activities.
Also, we note that items 2, 3, 5 and 6 in Appendix A are similiar to those found during inspections conducted in July and September 1976, January and February 1975, March 1975, May 1975 (Item 3); Dece=ber 1975 (Item 2 and 5) and May 1975 (Item 6).
In your responsa to this letter, please give these matters your particular attention.
In accordance with Section 2.790 of the NRC's " Rules of Practice," Part
- 2. Title 10, Code of Federal Regulations, a copy of this letter and the enclosures will be placed in the NRC's Public Document Room.
This notice is sent to you pursuant to the provisions of Section 2.201 of the NRC's " Rules of Practice," Part 2, Title 10, Code of Federal Regulations.
Section 2.201 requires you to submit to this office within twenty (20) days of your receipt of this notice a written statement or explanation'in reply including: (1) corrective steps which have been taken by you and results achieved; (2) corrective steps which will be taken to avoid further items of noncompliance; and (3) the date when full compliance will be achieved.
