Dear Administrative Judges:

Enclosed herewith are copies of the NRC Staff's testinony for the remaining issues in this proceeding, i.e.:

Contention 5 regarding the availability of effluent for cooling purposes for Unit 3 of PVNGS, Contention 6B dealing with measures to mitigate a postulated ATWS event, and Contention 7 in-volving financial qualifications and the proper computation of decomis-sioning costs.

It should be noted that Staff's testimony on Contention 5 does not ieal with two matters that have recently come to our attention. These include the February 10, 1982 letter to this Licensing Board from the Arizona Municipal Water Users Association concerning the renegotiation of effluent supply between the Association and the Applicants. The other matter is a suit filed on January 18, 1982 in the United States District Court for the District of Columbia (Civil Action File No. 82-0145) by the Salt Rive.

Pima-Maricopa Indian Commun'ty against the United States and James Watt, Secretary of the Interior, which is concerned in part with PVNGS' use of effluent from waters originating in the Salt. River that plaintiff alleges it has a clain upon. We shall separately mail you a copy of the complaint in that proceeding. Staff intends to amend its testimony dealing with these matters if they prove to be material.

The Licensing Board should further be advised that Contention 7 appears to be moot since the Commission on March 11, 1982 amended Parts 2 and 50 of the Commission's Regulations to eliminate the present financial qualifications k.%o7 /#
