As stated in your letter of December 29,1981,, Florida Power Corporation (FPC) does not consider TechnicaT5pe~Elficallon Change Request No. 64, Revision 1 to be subject to license fees pursuant to 10 CFR 170.22.
We understand that the Office of Nuclear Reactor Regulation (NRR) staff considers the review of our application to be site specific and,thus, not covered by the various safety evaluations published on TMI-2 Lessons Learned. We would have expected such a review, but must state for the record, that we are not aware of one. While the safety evaluation was associated with Crystal River Unit 3 and published "on our docket", all dialogue with the staff was strictly one-sided, (e.g.,
FPC shall utilize the model technical specifications). A checklist review was performed to ensure everything NRR had already approved was appropriately represented in the license amendment. To the best of our knowledge, a specific safety review was not performed.
Those changes that FPC considered appropriate were embodied in Change Request 64, Revision 0, which was about to be submitted when we received the model technical specifications from NRR. However, we were told emphatically that NRR had already determined what was necessary and that few, if any, changes would be considered. It was suggested in a telephone conference with the NRR staff that if we continued to resist the standard approach, we would be subject to an ordered license change. Thus, we were surprised to learn of a site specific safety evaluation beyond the checklist level.
We appreciate your office's efforts to resolve this problem and, based upon yout request, a license fee of 54,000 (four thousand dollars) is hereby remitted. However, we may choose to continue this dialogue with NRR.
