JJoyner, Reg. I This is in response to your letter dated December 1,1981 which transmitted a request for exemption from the requirements of License Condition 3.1 and 10CFR 70.58(e) to not measure the special nuclear material content of certain fuel material to be shipped offsite.
We have detemined that grar. ting your request will not adversely affect the common defense and security nor the public health and safety and is othemise in the public interest. Accordingly, the following license condition is being added to Amendment MPP-1 of your License No. SNM-368, effective immediately, to provide a limited exemption to 10CFR 70.58(e) s and License Condition 3.1:
Notwithstanding the requirements of 10CFR 70.58(e) and License Condition 3.1 to measure the uranium and uranium-235 content of the fuel identified in the licensee's letter dated December 1, 1981, the licensee may ship said fuel without measurement for uranium and uranium-235 provided the connitments in the 12/1/81 letter are met and any identified discrepancies resolved.
We have detemined that your letter dated December 1,1981 contains
'infomation of a type specified in 10CFR 2.790(d). Accordingly, pursuant to section 2.790(d)(1), such information is deemed to be concercial or financit.1 infomation within the meaning of 10CFR 9.5 (a)(4) and shall be subject to disclosure only in accordance with the provisions of 10CFR 9.12.
