Gentlemen:
Thank you for your February 2,1982 letter calling our attention to an error in the text of Notice of Violation enclosed with our letter to you of January 7, 1982.
While the reference in question should have been to the Nuclear Materials Custody and Control procedure, as you pointed out, the error is editorial in nature, and of minor significance to the central issue of the citation.
Title 10 Code of Federal Regulations Part 70.58 requires General Atomic Company to have a Fundamental Nuclear Materials Control Plan. General Atomic Company's generic internal guidance procedures, as you refer to them, are an extension of that plan in more specific terms. 10 CFR 70.58(j) further emphasizes that procedures are to be followed.
The Notice of Violation (see enclosure) has been recast to clarify this relationship. Note that since the editorial error was on our part we are extending the deadline for response.
Once again, the responses directed by this letter and the accompanying Notice s'
are not subject to the clearance procedures of the Office of Management and Budget as required by the Paperwork Reduction Act of 1980, PL 96-511.
In accordance with Section 2.790(d) of the NRC's " Rules of Practice," Part 2, Title 10, Code of Federal Regulations, documentation of the findings of your control and accounting procedures for safeguarding special nuclear material are exempt from public disclosure; therefore, the enclosure to this letter, the inspection report, and your response to the item listed in the enclosure to this letter will not be placed in the Public Document Room and will receive limited distribution.
