The Nuclear Regulatory Com.ission (the Commission) has found that:

A.

The issuance of this anendnent to the l'cGuire Nuclear Station, Unit 1 (the facility) Facility Operating License No. NPF-9 complies with the standards and requirements of the Atomic Energy Act of 1954, as auanded (the Act) and the Commission's regulations as set forth in 10 CFR Chapter I; B.

The facility will operate in conformity with the application, as anended, the provisions of the Act, and the regulations of the Com-mission; C.

There is reasonable assurance: (i) that the activities authorized by this cxndaent can be conducted without endangering the health and safety of the public, and (ii) that such activities will be conducted -in compliance with the Commission's regulations set forth in 10 CFR Chapter I; D.

The it.suance of this license amendment will not be inimical to the common defense and security or to the health and safety of the public; E.

The issuance of this amendment is in accordance with 10 CFR Part 51 of the Conmission's regulations and all applicable requirenents have been satisfied.

Accordingly, the license is hereby amended as follows:

Change paragraph 2.C.(11)h.(1) to read as follows:

j (1) Prior to startup following the first refueling outage, the Commission must confirm that an adequate hydrogen control system for the plant is installed and will perfonn its intended function in a manner that provides adequate safety margins.

SAFETY EVALUATION BY THE

.i 0FFICE OF NUCLEAR REACTOR REGULATION RELATED TO AMENDMENT N0.13 TO LICENSE NPF-9 DUKE P0'.lER CO?.PANY i

INTRODUCTION By letter dated October 30, 1981, the licensee submitted.the results of their inves-tigations in which they state the licensing conditions (Ref: McGuire Nuclear Station Unit 1, Operating License NPF-9) for installation of an adequate hydrogen mitigation system by January 31, 1982 are satisfied. An additional license condition requires that for operation beyond January 31, 1982, the Commission must confirm that an ad quate hydrogen control system for the plant is installed and will perform its isended function in a minner that provides adaquate safety margins.

EVALUATION The licensee together with the Tennessee Valley Authority (Sequoyah) and American Electric Power Corp. (D. C. Cook) are continuing their cooperative efforts on Lydec9en control Juasures and the possible effects of hydrogen burn on safety functions. The participants in their R & D program have experienced delays in assimilating information from numerous sources outside of the respective utility organization. Conplete information is not expected until late December 1981 from the EPRI test prograc which includes igniter development, hydrogen combustion and mixing studies.

With respect to the survivability of equipment in the event of hydrogen burns, the licensee states that all essential equipment would survive hydrogen burning and could be depended on to operate when hydrogen burning ceased.

They consider their analysis to be based on conservative assumptions concerning geometry and heat trensfer coefficients, and submit that it considers all relevant for s of heat transfer in culti-din.ansional configuration. Modified CLASIX code results used in the analysis show less severe thernal environments than previously assumed which support their conclusion that safety equipment will survive hydrogen burns. The staff's evaluation of equipment survivability will be based on an assessment of the adequacy of the licensee's submittals.

Because additional licensee information did not become available until late December 1981, the staff now anticipates conpleting its evaluation on the adequacy of the information and the installed permanent hydrogen mitigation system by April 1982.

Relatedly, the Commission authorized deferral of the installation of the proposed

e permanent hydrogen mitigation system in Sequoyah Unit 2 until the first refueling (estimated March 1983) to avoid a lengthy forced outage. This was acceptable principally on the basis that the installed interim system is very similar to the proposed final system in that it has the same functional capability, equivalent coverage by location, and diesel generator backup power supply. No information has evolved which would cause the staff to rescind our approval of the mitigation system for interim use.

The delays in corpletion of the R & D program also adversely affect McGuire Unit il in that the staff will not be able to complete its review of the system until well beyond the date when the current license condition for McGuire Unit 1 calls f or NRC approval to be completed.

The installed McGuire system is comparable to that of Sequoyah with some improvenents.

Since this change entails no significant hazards consideration we will modify License NPF-9 to reflect that the date for the Commission to confirm the adequacy of the system will be changed f rom January 31, 1982, to prior to the startup following the first refueling for Unit 1.

,L]jVIR0= ENTAL CONSIDERATION We have determined that the amendment does not authorize a change in effluent types or total amounts nor an increase in power level and will not result in any significant environmantal impact.

Having made this determination, we have further concluded that the amandr..ent involves an action which is insignificant from the standpoint of environmental impact and, pursuant to 10 CFR Section 51.5(d)(4), that an environmental impact statement or negative declaration and environmental impact appraisal need not be prepared in connection with the issuance of this amendment.

00*jCLUS10N h'e have concluded, based on the consideration discussed above, that: (1) because the amendment does not involve a significant increase in the probability or con-sequences of accioents previously considered and does not involve a significant decrease in a safety margin, the amendment does not involve a significant hazards consideration, (2) there is reasonable assurance that the health and safety of the public will not be endangered by operation in the proposed manner, and (3) such dctivities will be conducted in compliance with the Commission's regulations and the issuance of this amendment will not be inimical to the common defense and j

security or to the health and safety of the public.

Issuance of this anendnent complies with the standards and requirements of the Atcaic Energy Act of 1954, as anended (the Act), and the Commission's regu-lations. The Commission has made appropriate findings as required by the Act and the Conmission's regulations in 10 CFR Chapter 1, which are set forth in the license cuendaent. Prior public notice of this amendment was not required since the amendment does not involve a significant hazards consideration.

The Comaission has determined that the issuance of this amendment will not result in any significant environmental impact and that pursuant to 10 CFR 551.5(d)(4) an environmental impact statement, or negative declaration and environ-mental impact appraisal need not be prepared in connection with issuance of this amendment.
