Appendix A NOTICE OF VIOLATION Tinken Mercy Medical Center-License No.134-01954-01 As a ' result of the inspection._ conducted on September 1,1981, and in accordance with the Interim Enforcement Policy, ;45 ER 66754.(October 7, 1980), the following violations were identified:
1.
10 CFR 30.34(c) states each person licensed by the Commission'shall-confine his possession and use of byproduct material'to the locations and purposes authorized in the license.
License Condition No. 17. requires that licensed material be possessed and used in accordance'with the' statements, representations, and procedures contained in the application dated January 20, 1978, and letter dated May 26, 1978. The January 20, 1978, application describ-es the floor plan for the nuclear medicine hot lab, camera room, and xenon ventilation system.
Contrary to the above requirement, on November 28, 1978, the nuclear medicine department was moved into a new location. The new location and new xenon ventilation system has not been approved by the Commis-sion and therefore is not authorized in the license.
This is a Severity Level V violation (Supplement VII).

10 CFR 35.14(e)(1)(i) requires that sealed calibration or reference sources possessed pursuant-to 10;CFR 35.14(d) be tested for leakage and/or contamination at intervals _not to exceed six months.
Contrary to this requirement, as of the date of the inspection, a 199 microcurie cesium-137 calibration source has not been leak tested since July 24, 1979, and a 259 microcurie barium-133 calibration-scurce has not been leak tested since July 9,1979.
This is a Severity Level V violation (Supplement VII).
3.
License Condition No.17 requires.that licensed material be possessed and used in accordance with the statements, representations, and procedures contained in thefapplication dated January 20, 1978, and.
letter dated May-26, 1978. The May 26, 1978, letter states in Item No. I that the dose calibrator linearity checks.wil1~ be performed quarterly.

Appendix A Contrary to the above, the dose calibrator has not been tested for linearity from October 8,1980, to tht date of the inspection, a period of more than one quarter.
This is a Severity Level V violation (Suppleiaent VII).
Pursuant to the provisions of 10 CFR 2.201, you are required to submit to this office within thirty days of the date of this Notice a written statement or explanation in reply, including for each item of noncom-pliance:
(1) corrective action tt'2en and the results achieved; (2) cor-rective action to be taken to avoid further noncompliance; and (3) the date when full compliance will be achieved. Under the authority of Section 182 of the Atomic Energy Act of 1954, as amended, this response shall be submitted under oath or affirmation. Consideration may be given to extending your response time for good caur.e shown.
