Dear Ms. Steves:

We have reviewed the final and proposed revisions to the Kansas Administrative Regulations K.A.R. 28-35-135, 28-35-178, 28-35-181, 28-35-184, 28-35-189, 28-35-192, 28-35-227, 28 231, 28-35-264, 28-35-338, 28-35-503, 28-35-504, and 28-35-700, received by our office on December 13, 2019. These regulations were reviewed by comparison to the equivalent U.S.

Nuclear Regulatory Commission (NRC) rules and Regulation Amendment Tracking System Identification Numbers (RATS IDs) 2012-2, 2012-3, 2012-4, 2013-1, 2015-1, 2015-2, 2015-4, 2015-5, 2018-1, and 2018-2 as identified in the enclosed State Regulation Status (SRS) Data Sheet. We discussed our review of the regulations with James Uhlemeyer on March 30, 2020.

As a result of our review, we have five comments that have been identified in the enclosure.

Please note that we have limited our review to regulations required for compatibility and/or health and safety. We have determined that if these regulations are revised, incorporating our comments and without other significant change, they would meet the compatibility and health and safety categories established in the Office of Nuclear Material Safety and Safeguards (NMSS) Procedure SA-200, Compatibility Categories and Health and Safety Identification for NRC Regulations and Other Program Elements.

We request that when you revise your regulations to address our comments, a copy of the as published regulations be provided to us for review. As requested in NMSS Procedure SA-201, Review of State Regulatory Requirements, please highlight the location of any changes made by Kansas, in response to our comments, and provide a copy to Division of Materials Safety, Security, State, and Tribal Programs, NMSS. The SRS Data Sheet summarizes our knowledge of the status of other Kansas regulations, as indicated. Please let us know if you note any inaccuracies, or have any comments on the information contained in the SRS Data Sheet. Self-luminous products containing tritium, krypton-85, or promethium-147 In Section 28-35-192f(b), Kansas implies that they will issue a specific license for toys, adornments, or similar items. The NRC does not license radioactive materials for frivolous use such as these items.

Kansas needs to delete this section of their regulations.

Also, Kansas omits the phrase, for a certificate of in Section 28 192f(a). Kansas needs to insert this phrase.

Kansas needs to make the changes indicated above to meet the Compatibility Category B designation assigned to 10 CFR 30.19(b).

2 28-35-192e 30.20 2012-4 B

Gas and aerosol detectors containing byproduct material In Section 28-35-192e(a):

a) Kansas omits their equivalent phrase to, for a license set forth in section 81 of the Act; and b) Kansas includes the word, imported which is not included in 10 CFR 30.20; In Section 28-35-192e(b):

a) Kansas omits the phrase, from regulatory requirements; b) Kansas adds requirements that are not in 30.20(b) i.e.,

they inserted the phrase, under subsection (a) if the device is labeled in

Calibration or reference sources containing americium-241 or radium-226: Requirements for license to manufacture or initially transfer In Section 28-35-181j(a):

a) Kansas should delete the title Dry wipe test. in (B);

and b) Kansas omits an equivalent requirement to 32.57(e)(3) which states, (3) The sources are inspected for evidence of physical damage and for loss of americium-241 or radium-226, after each stage of testing, using methods of inspection adequate for determining compliance with the criteria in paragraph (e)(4) of this section.

Kansas needs to make the changes indicated above to meet the Compatibility Category B designation assigned to 10 CFR 32.57(e).

Registration of product information

Records Kansas equivalent regulation to 10 CFR 40.61.(a)(2) is less restrictive and does not meet essential objectives, i.e., they need to state that these records shall be retained until their agency terminates the license, not just for 3 years.

Kansas needs to make the change indicated above to meet the Compatibility Category C designation assigned to 10 CFR 40.61(a)(2).
