Dear Sir,
in response to RIN 3150-AE49, "FY1991 AND 1992 Final Rule Implementing the U.S. Court of Appeals Decision and Revision of Fee Schedules: 100% Fee Recovery, FY1993", published in 58 FR 38666 (7/20/93) I would like clarification on two issues. It is inferred in the document that the "two part test" for an exemption from fees will be severe financial hardship and significant externalized benefits. No criteria for this test is defined.
What is the two part test?
What are the criteria for the test that will determine eligibility for an exemption?
