SUBJECT: NRC ENFORCEMENT CONFERENCE, REPORT NUMBER 50-331/93013(DRP)

This refers to an Enforcement Conference conducted by Mr. J. B. Martin and

other members of the Region III staff on July 29, 1993, regarding activities

at the Duane Arnold Energy Center and to the discussion of our findings with

your staff.

This Enforcement Conference was conducted as a result of the

findings of an inspection conducted from May 22 through July 7, 1993, and of

an event which occurred on July 22, 1993, in which two apparent violations of

NRC regulations were identified.

Inspection report (IR) 50-331/93009(DRP),

dated July 23, 1993, documented the results of the inspection conducted from

May 22 through July 7,1993, and the enclosed report documents the event which

occurred on July 22, 1993. The enclosed report summarizes the conference.

Based on the information presented in the Enforcement Conference and on

further review by the NRC, we have determined that escalated enforcen,ent is

not warranted for these matters.

However, certain of your activit ies appeared

to be in violation of NRC requirements, as specified in the enclosed Notice of

Violation (Notice). The first violation involved the "A" standby diesel

generator (SBDG) being inoperable for a time in excess of that allowed by

technical specifications.

However, the significance of the event was reduced

because the "B" SBDG was operable, all emergency core cooling systems were

operable, and the "A" SBDG could have been started by locally resetting the

overspeed trip.

Furthermore, the cause of the

"A" SBDG being inoperable

appeared unavoidable by reasonable management controls or quality assurance

measures. Although the violation met the crite~ia for enforcement discretion,

we have chosen not to exercise this option because of the significance we

attach to an emergency source of electrical power being inoperable for an

extended time period.

The second violation consisted of two examples of failure to follow procedures

by control room operators.

In the first example, a control room operator

incorrectly performed a step in a surveillance test procedure.

Due to this

failure, control room operators were naaware of the status of an important

emergency core cooling system compon a for about 14 hours1.62037e-4 days <br />0.00389 hours <br />2.314815e-5 weeks <br />5.327e-6 months <br /> even though the

condition was indicated on the "B" core spray mimic panel in the control room.

In the second example, on July 22, 1993, an operator omitted a portion of a

step in a surveillance test procedure. The step was correctly performed only

after the error was pointed out by the NRC inspector who witnessed the

surveillance test. These failures, combined with other recent problems

'

identified with shift briefings and inappropriate annunciators, raised

significant concerns that your control room operations have not been conducted

with an appropriate attention to detail and sensitivity for safety.

This

performance does not conform to the high standards of professionalism and

quality normally present and expected in the control room of a nuclear power

,

'

You are required to respond to this letter and should follow the instructions

specified in the enclosed Notice when preparing your response.

In your

response, you should document the specific actions taken and any additional

actions ycu plan to prevent recurrence. After reviewing your response to this

Notice, including your proposed corrective actions and the results of future

inspections, the NRC will determine whether further NRC enforcement action is-

necessary to ensure compliance with NRC regulator., requirements.

In accordance with 10 CFR 2.790 of the Commission's regulations, a copy of

this letter, the enclosures, and your response to this letter will be placed

in the NRC Public Document Room.

The responses directed by this letter and the accompanying. Notices are not
