SUBJECT: NOTICE OF VIOLATION AND NOTICE OF DEVIATION
NRC INSPECTION REPORT NOS. 50-528/529/530/93-26
This refers to the inspection conducted by J. Sloan, H. Freeman, A.
MacDougall, and F. Ringwald of this office, on June 1 through July 12, 1993.
The inspection included a review of activities authorized for your Palo Verde
facility. At the conclusion of the inspection, the findings were discussed
with those members of your staff identified in the enclosed report.
Areas examined during the inspection are identified in the report.
Within
these areas, the inspection consisted of selective examinations of procedures
and representative records, interviews with personnel, and observation of
activities in progress.
Based on the results of this inspection, certain of your activities appeared
to be in violation of NRC requirements, as specified in the enclosed Notice of
Violation (Notice). These violations involved (1) the inadequate
documentation and review of deficiencies identified during testing, (2) a
programmatic weakness that allowed a significant change to a surveillance test
to be implemented without a review to ensure that the change did not create an
unreviewed safety question, and (3) the failure to adequately review a design
change to ensure that post-modification testing was comprehensive.
The inspection also identified three non-cited violations regarding the
failure to identify applicable regulatory requirements associated with a
design change, and the failure to comply with ASME Code requirements for
instrumentation used for surveillance testing and for the design of leak-off
lines for main steam and feedwater isolation valves. These violations were
not cited because the criteria specified in Section VII.B. of the Enforcement
Policy were satisfied.
The inspection also identified one deviation regarding the qualifications of
your engineering personnel. This deviation indicates that the several changes
you have made to your program and your commitments in this area have not been
well planned. Although your engineering personnel are capable and competent,
discrepancies have been identified because their documented qualifications did

not match your program or commitments.
This deviation specifically addresses

technical support in a position to sense when internal resources to address
emerging problems are inadequate. The continued discrepancies in this area
warrant additional attention.
You are required to respond to this letter and should follow the instructions
specified in the enclosed Notice when preparing your response.
In your
response, you should document the specific actions taken and any additional
actions you plan to prevent recurrence. Please specifically address your
i
corrective actions for the programmatic deficiency identified regarding review
of surveillance test changes. After reviewing your response to this Notice,
including your proposed corrective actions and the results of future
inspections, the NRC will determine whether further NRC enforcement action is
necessary to ensure compliance with NRC regulatory requirements.
In accordance with 10 CFR Part 2.790 of the NRC's " Rules of Practice," a copy
of this letter and the enclosures will be placed in the NRC Public Document-
Room.
The responses directed by this letter and the enclosed Notice are not subject
to the clearance procedures of the Office of Management and Budget as required
by the Paperwork Reduction Act of 1980, Pub. L. No. 96.511.
