EMERGENCY PREPAREDNESS EXERCISE INSPECTION AT FERMI 2

This refers to the routine safety inspection conducted by Ms. H. Simons of

this office and others on July 13-16, 1993. The inspection included a review

,

of authorized activities at your Fermi 2 Nuclear facility. At the conclusion

of the inspection, the findings were discussed with those memoers of your

staff identified in the enclosed report.

Areas examined during the inspection are identified in the report. Within

these areas, the inspection consisted of a selective-examination of procedures

and representative records, interviews with personnel, and observation of-

activities in progress.

Based on the results of this inspection, certain of your activities appeared

to be in violation of NRC requirements concerning the failure to notify _the

NRC within one hour of declaring an Unusual Event. However, as described in

the enclosed inspection report, you identified this . violation.

Therefore, the

violation will not be subject to enforcement action because your_ efforts in

,

identifying and correcting the violation meet the criteria specified in

Section VII.B of the " General Statement of Policy and Procedures for NRC

Enforcement Actions," (Enforcement Policy, 10 CFR Part 2, Appendix C).

In addition, one exercise weakness, regarding the failure to classify a Site

Area Emergency was identified during this inspection which will require

corrective action.

This weakness is summarized in the Appendix to this

letter. As required by 10 CFR 50, Appendix E (IV.F), any weaknesses that are

In accordance with 10 CFR 2.790 of the Commission's regulations, a copy of

Public Document Room.

APPENDIX

Exercise Weakness

10 CFR 50.54(q) requires that the licensee follow and maintain an emergency

plan.

The licensee's emergency plan required that a Site Area Emergency be

declared based on a fire affecting nuclear safety systems or engineered safety

features.

However, during the 1993 exercise, the licensee failed to properly classify a

Site Area Emergency based on a fire affecting an engineered safety feature.

This concern is discussed in Section 5a of Inspection Report 50-341/93009.
