AUG 4 1993 Docket No. 55-20237 License No. S0P-20889 EA 93-197 Mr. James D. Phillips

[HOME ADDRESS DELETED UNDER 10 CFR 2.790]

Dear Mr. Phillips:

The Nuclear Regulatory Commission (NRC) has received a letter dated July 14, 1993, from Duke Power Company's McGuire Nuclear Station informing us of your confirmed positive test for alcohol on June 15, 1993 (copy enclosed).

We want to make clear to you the consequences of your actions as related to the requirements governing fitness for duty as a licensed operator. The purpose of the NRC's Fitness-for-Duty requirements is to provide reasonable assurance that nuclear power plant personnel work in an environment that is free of drugs and alcohol and the effects of the use of these substances. The abuse of alcohol is a serious matter which undermines the special trust and confidence placed in you as a licensed operator.

The NRC considers an operator's fitness-for-duty to be crucial to the protection of the public health and safety because of the vital role licensed operators have in the-safe operation of nuclear power facilities. Therefore, you are reminded that your individual license is subject to all of the provisions of 10 CFR Part SS.

4 10 CFR 55.61, " Modification and Revocation of Licenses," states in part that Any license may be revoked, suspended, or modified, in whole or in part... for a determination of unfitness for scheduled work as a result of the consumption of alcoholic beverages."

Based upon the actions already taken by the Duke Power Company, the NRC has decided to take no action with respect to your license beyond the issuance of this letter.

Be advised that, should you exceed a second time the drug or alcohol limits specified in tne Duke Power Company Fitness-for-Duty policy, your reactor operator . cense may be affected as discussed in 10 CFR Part 2, Appendix C, " General Statement of Policy and Procedures for NRC Enforcement Actions." Also, you should be aware that your employer's Fitness-for-Duty Policy incorporates the requirements of 10 CFR Part 26, " Fitness for Duty Programs." A similar problem in the future may substantially affect your authorization for unescorted access to a protected area of a licensed facility.

We plan to place this letter and the July 14, 1993, letter from the Duke Power Company in your 10 CFR Part 55 docket file.
