SUBJECT:

NRC INSPECTION REPORT NOS 50-220/93-14; 50-410/93-14, AND

NOTICE OF VIOLATION

This letter transmits the findings of the June 21 - 22,1993, inspection conducted by

Messrs. A. Burritt and R. Conte along with the July 6 - 8,1993, inspection by C. E. Sisco

of this office at the Nine Mile Point Units 1 and 2, Scriba, New York. This inspection dealt

with your actions to reduce plant trips and upgrade facility procedures. Both actions have

safety importance with respect to avoiding unnecessary challenges to safety equipment and

the licensed operators. At the conclusion of the inspection, the findings were discussed with

those members of your staff identified in the enclosed report.

Based on the results of these inspections, certain of your activities appeared to be in violation

of NRC requirements, as specified in the enclosed Notice of Violation (Notice). You are

required to respond to this letter and should follow the instructions specified in the enclosed

Notice when preparing your response. In your response, you should document the specific

actions taken and any additional actions you plan to prevent recurrence. After reviewing

your response to this Notice, including your proposed corrective actions and the results of

future inspections, the NRC will determine whether further NRC enforcement action is

necessary to ensure compliance with NRC regulatory requirements.

Also, we note that facility operating procedure deficiencies appear to be a persistent problem

at your facility. We understand you have a procedure upgrade program in progress but we

are concerned that it will not be effective in dealing with these issues. In addition to

,

responding to the attached notice of violation, we request you specifically address this

!

persistent problem and specify what additional management control systems are in place or

will be in place to prevent recurrence.

Further, we request that you respond in 30 days of receipt of this letter to the issues

addressed in Section 3.1. of this report dealing with the format and content of event based
