Gulf States Utilities (EA 93-167)

50-458 Subiect:

PROPOSED IMPOSITION OF CIVIL PENALTY - $100,000 This is to inform the Commission that a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $100,000 will be issued on or about August 5, 1993 to Gulf States Utilities (River Bend Station).

This action is based on a Severity Level III problem, involving (1) the June 1992 failure to verify post-maintenance internal clearances on a main steam isolation valve (MSIV); (2) the subsequent failure to pursue MSIV closure discrepancies (on the same valve) during February and April 1993 surveillance tests; and (3) the resultant failure to meet Technical Specification requirements for MSIV operability from February 27 to April 18, 1993.

The base Severity Level III civil penalty of $50,000 was mitigated 50 percent for identification and 50 percent for corrective actions.

These reductions were offset by 100 percent escalation for prior opportunities to identify the violation and 100 percent escalation for duration.

These considerations resulted in a net increase of $50,000.

l It should be noted that the licensee has not been specifically informed of the enforcement action.

l The licensee has thirty days from the date of the Notice in which to l

respond.

Following NRC evaluation of the response, the civil. penalty may be remitted, mitigated, or imposed by Order.
