By letters dated April 3,

1989, April 24, 1989, July 17, 1989, November 9, 1989, August 13, 1990 and March 7, 1991, Duke Power i

responded to NRC Bulletin 88-10 and the supplement.

This letter is to clarify the commitment made in the original response concerning the procurement of non-safety related breakers.

The NRC bulletin was concerned with safety related and commercial grade circuit breakers intended for safety related applications.

In our response to the first action requested by the bulletin, we specifically referred to safety related and commercial grade breakers -for safety related use.

The response to the second requested action referred to breakers installed in safety related applications.

The response to the fifth requested action stated:

"We have taken steps to ensure that CBs installed after August 1, 1988, will be procured from a CBM under a 10 CFR 50, Appendix B

program, or procured from a

CBM or others with verifiable traceability to the CBM, in compliance with applicable industry standards. We will upgrade those CBs purchased commercial grade to safety related using our dedication program."

It is evident from the last sentence and also from the context of the letter, that we I

were concerned only with safety related breaker applications in relation to future breaker procurement.

In the July 17, 1989 letter, we stated that:

"we have also implemented actions required by the NUMARC initiative regarding non-safety related molded case CBs."

Element 4 of this initiative stated:

"For future purchase orders, specification should be made that all breakers supplied shall be new, and utilities should ensure, to the extent possible, that breakers received have come I

from the circuit breaker manufacturer.

Pending orders should be amended to reflect these requirements as well."

A clarification from NUMARC on March 29, 1993, stated that "the actions taken by l 0 9307290200 930719 If

substandard MCCBs into nuclear power plant applications concluded that specifying new on the purchase order with supporting confirmation from the manuf acturer or authorized distributor should be sufficient for NSR applications."

McGuire has been procuring all MCCBs through the stricter controls required for safety related applications, including breakers purchased for non-safety usage.

We do not believe it is : cost effective to continue this practice. Therefore, based on the above discussion, we propose to change our response to Requested Action 5 of Bulletin 88-10 to the following:

"We have taken steps to ensure that CBs to be used in safety related applications installed after August 1,

1988, will: be procured from a CBM under a 10 CFR 50, Appendix B program, or procured from a CBM or others with verifiable traceability to the CBM, in compliance with applicable industry standards.

We will upgrade those CBs purchased commercial grade to safety related using our dedication program."

If there are no comments received from the NRC on this clarification to our commitment to Bulletin 88-10, McGuire plans-revise our practice to procure non-safety related MCCBs from an authorized distributor OR from the manufacturer on August 2, 1993.
