NOTICE OF VIOLATION j

l Combustion Engineering, Incorporated Docket No. 70-1100 Windsor, Connecticut 06095 License No. SNM 1067 During an NRC inspection conducted on May 11-13,1993, a violation of NRC requirements was identified. In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C, the violation is listed below:

License Condition 9 of License No. SNM-1067 incorporates the NRC-approved license application into the facility license. Section 2.6 " Operating Procedures" of the NRC-approved license application states, in part, that written procedures that affect radiation and/or nuclear criticality safety shall include limits and controls which are required for nuclear safety of the subject activity.

Contrary to the above, on May 11,1993, an opemtion was being conducted at the Rod-Loading table in the Pellet Shop, but the applicable procedure, " Operations Sheet No.

510, Revision 84," dated January 30, 1992, had not been modified to establish appropriate controls for the radiation safety of the workers. Specifically, the Rod-Loading table was not equipped with beta-shields.

This is a Severity Level IV violation (Supplement VI D).

Pursuant to the provisions of 10 CFR 2.201, Combustion Engineering, Inc. is hereby mquired to submit a written statement or explanation to the U.S. Nuclear Regulatory Commission, A'ITN: Document Control Desk, Washington, D.C. 20555 with a copy to the Regional Administrator, Region I, within 30 days of the date of the letter transmitting this Notice of Violation (Notice). This reply should be clearly marked as a " Reply to a Notice of Violation" and should include for each violation: (1) the reason for the violation, or, if contested, the basis for disputing the violation, (2) the corrective steps that have been taken and the results achieved, (3) the corrective steps that will be taken to avoid further violations, and (4) the date when full compliance will be achieved.
