SUMMARY
The Thermo-Lag Action Plan addresses the technical and programatic issues related to the use of Thermo-Lag fire barriers by nuclear reactor licensees to satisfy U.S. Nuclear Regulatory Comission (NRC) requirements. Many of the issues were documented in the " Final Report of the Special Review Team for the Review of Thermo-Lag Fire Barrier Performance," of February 11, 1992, and in the Office of the Inspector General Inspection Report entitled, ' Adequacy of NRC Staff's Acceptance and Review of Thermo-Lag 330-1 Fire Barrier Material," of August 12, 1992. This is the third quarterly action plan update. SIGNIFICANT NRC STAFF ACTIONS DURING THE PAST SIX MONTHS o Met with the Nuclear Management and Resources Council (NUMARC) to discuss the industry Thermo-Lag test program (Action Plan Part I) o Witnessed small-scale fire tests performed by NUMARC (Part I) o Issued a generic letter (Part I) o Reviewed licensee responses to two previous bulletins and to the generic letter (Part I) Completed a small-scale Thermo-Lag fire test program (Part II) o o Began reviewing fire barriers other than Thermo-Lag and issued two information notices (Part II) o Approved the Thermo-Lag fire barrier program for Comanche Peak (Part III) o Reviewed the fire and ampacity derating test programs for Watts Bar Nuclear (Part III) o Completed a reassessment of the NRC fire protection program (Part IV) and developed an action plan to address the report recomendations (P et V) o Responded to congressional questions and participated in a subcomittee hearing (Part V) o Issued a final deM 4 in response to a 10 CFR 2.206 Petition (Part V) PLANNED ACTIONS o Finalize and issue fire endurance test acceptance criteria (Part I) o Continue the review of the NUMARC test program, plant specific test programs, and implementation of the test results by industry (Parts I and III) o Finalize inspection guidance and conduct fire barrier inspections (Part III) _j_
THERMO-LAG ACTION PLAN THIRD QUARTERLY UPDATE r INTRODUCTION The Thermo-Lag Action Plan addresses resolving the technical and programmatic issues relating to Thermo-Lag 330 fire barrier systems supplied to the nuclear industry by Thermal Science, Incorporated. Many of the issues related to these systems were documented in the " Final Report of the Special Review Team for the Review of Thermo-Lag Fire Barrier Performance," of February 11, 1992 and April 1992. In its report of April 1992, the special review team concluded that: (1) The fire-resistive ratings and the ampacity derating factors for the Thermo-Lag 330-1 fire barrier system are indeterminate. (2) Some licensees have not adequately reviewed and evaluated the fire endurance test results and the ampacity derating test results used as the licensing basis for their Thermo-Lag fire barriers to determine the validity of the tests and the applicability of the test results to their plant , designs. (3) Some licensees have not adequately reviewed the Thermo-Lag fire barriers installed in their plants to ensure that they meet NRC requirements and guidance, such as that provided in Generic Letter 86-10, " Implementation of Fire Protection Requirements," April 24, 1986. (4) Some licensees used inadequate or incomplete installation procedures during the construction of their Thermo-Lag fire barriers. In addition, the Office of Inspector General (OIG) Inspection Report entitled, " Adequacy of NRC Staff's Acceptance and Review of Thermo-Lag 330-1 Fire Barrier Material," of August 12, 1992, found that the NRC staff did not conduct an adequate review of fire endurance and ampacity derating information concerning the ability of Thermo-Lag fire barrier material. The staff incorporated in the Thermo-Lag Action Plan tasks to address the following matters raised by the Commission in a memorandum of August 17, 1992, from its review of the OIG report (1) The initial review process did not identify problems with Thermo-Lag 330-1, and deficiencies in the staff's response to later indications of problems existed. (2) Problems identified with respect to the initial review and the lack of follow-up to later indications of problems may represent a systematic weakness with the staff's review and response programs. (3) Corrective actions may be necessary to rectify deficiencies identified with respect to the review and response processes. The Thermo-Lag Action Plan is divided into the following five parts: Part I Review and evaluate technical issues with industry coordination (as appropriate) and evaluate the industry's actions to resolve the fire barrier issues. Part II Sponsor small-scale fire tests to address concerns with combustibility and fire performance. Part III Prepare inspection guidance to assist the regions in evaluating the adequacy of fire barrier configurations in the plants and conduct inspections. Part IV Assess the NRC's programatic review and inspection processes regarding various aspects of the NRC fire protection program. Par' V Oversee action plan implementation, prepare status reports, respond to 10 CFR 2.206 petitions, respond to Congressional requests, and brief management. A personal' computer-based project management program is used to track and manage the Thermo-Lag Action Plan. The program tracks and manages task details, schedules milestones and completion dates, and assigns resources. The attachment to this action plan is a Gantt chart that identifies each task with its schedule and status. The Thermo-Lag Action Plan is a living document. It is revised as needed to incorporate tasks that arise during the review, and to account for changing resources, work assignments, and priorities. Completion of the Thermo-Lag Action Plan within the stated schedules is dependent on the availability of resources. A reassessment of the NRR reactor fire protection program was performed under Part IV of the Thermo-Lag Action Plan in response to the programatic concerns raised during the review of Thermo-Lag fire barriers. The results of the reassessment were provided in the Report on the Reassessment of the NRC Fire Protection Program of February 27, 1993. This action completed Part IV of the Thermo-Lag Action Plan. The reassessment report contained a number of recomendations. Implementation of the recomendations is addressed in a separate Fire Protection Task Action Plan (FP-TAP) and a separate Equipment Qualification Task Action Plan (EQ-TAP). There is some duplication of tasks between the Thermo-Lag Action Plan and the FP-TAP. Tasks not directly related to Thermo-Lag issues will be deleted from the Thermo-Lag Action Plan at its next revision. Areas the staff plans to revise are discussed below. PART I TECHNICAL ISSUES Objective: To coordinate resolution of technical issues with the i industry, to monitor and review industry's actions, and to ensure that these actions adequately resolve the technical Thermo-Lag Task Action Plan June 16, 1993
issues associated with performance of Thermo-Lag fire barriers. Scope: Resolve the Thermo-Lag issues identified by the special review team and the OIG and that arise during the overall review. Coordinate with NUMARC and individual licensees to resolve issues and resolve fire testing methodology and acceptance criteria by conducting public meetings, reviewing submittals, and observing fire endurance and ampacity tests. Review the other fire barriers used to meet NRC requirements and guidance. (This task will be relocated to the FP-TAP.) Issue Information Notices as appropriate. Issue Generic Letter 92-08, "Thermo-Lag 330-1 Fire Barriers." Prepare a staff position on fire endurance test acceptance criteria. Issue the position with Supplement I to Generic Letter 86-10 " Implementation of Fire Protection Requirements." Review licensee responses to the generic communications. Assess variations of Appendix R requirements such as. reduced duration, fire barriers, effectiveness of suppression, and effectiveness of fire watches. Staff effort: 4.0 staff years. Completion date: November 1994 (WITS Control No. 9200188). Status: Completion date and tesources unchanged. NUMARC delayed the industry test program by three months. However, this activity was not on the critical path for completion of Part I. Therefore, neither the Part I completion schedule nor the overall completion schedule has changed. The staff met with the Nuclear Management and Resources Council (NUMARC) to discuss the industry Thermo-Lag test program; witnessed NUMARC-sponsored combustibility tests at Underwriters Laboratories; and reviewed responses to Generic Letter 92-08. The also staff finalized its proposed fire test acceptance criteria and presented to the Committee for 1 the Review of Generic Requirements a proposed generic letter supplement to issue the criteria. Staff plans to support the revision of Appendix R and to assess the variations of Appendix R requirements are detailed in the FP-TAP. this effort will be deleted from the Thermo-Lag Action Plan at the next update. PART 11 NRC TESTING Objective: To determine the combustibility and assess the fire endurance performance of Thermo-Lag 330-1 fire barrier materials by conducting small-scale tests. Scope: Develop, conduct, and document the results of the NRC test program. Staff effort: 1.0 staff year. Completion date: August 1993 (WITS Control No. 9200189). Status: The completion schedule for Part II was reduced by 4 months (from December 1993 to August 1993) due to the deletion of the full-scale test program from the Thermo-Lag Action Plan. Information regarding the full-scale test program is directly related to an ongoing investigation and, therefore, is subject to limited distribution. In addition, the program is not related to resolution of technical issues. Therefore, the Chairman of the Investigative Task Force requested that the staff delete this activity from the Thermo-Lag Action Plan. The Investigative Task Force will inform the Comission of the status of this program through Agency procedures for investigations, as requested. The resources were not reduced because the staff will continue to provide technical support to the Investigative Task Force. The staff completed the small-scale Thermo-Lag fire test program at the National Institute of Standards and Technology. The staff also started its review of the other fire barrier systems used to meet NRC requirements. The staff issued Information Notice 93-40, " Fire Endurance Test Results for Thermal Ceramics FP-60 Fire Barrier Material," May 26, 1993, and Information Notice 93-41, "One Hour Fire Endurance Test Results for Thermal Ceramics Kaowool, 3M Company FS-195 and 3M Company Interam E-50 Fire Barrier Systems," May 28, 1993. The staff informed the Commission of the initial results of this review in a memorandum of May 25, 1993. Staff plans to review fire barrier materials other than Thermo-Lag, including small-scale tests, are detailed in the FP-TAP. Therefore, this activity will be deleted from the Thermo-Lag Action Plan at its next revision. Thenno-Lag Task Action Plan June 16, 1993
I PART III INSPECTION PROGRAM Objective: To develop'and implement fire barrier inspection guidance the regions can use to evaluate a licensee's ability to meet the NRC's fire protection program requirements for raceway fire barriers in accordance with its technical specifications, commitments, or license conditions. Scope: Develop and issue a Temporary Instruction (PTA) to the regions for fire barrier inspections. Conduct inspection workshops for the regions. -{ Assist the regions, as necessary, in resolving the issues found during fire barrier inspections, including supplying technical guidance for issues identified during the 1 inspections. Coordinate with the regions and track plant-specific issues identified in the special review team final report of February 11, 1992 and other sources, j Staff effort: 8 staff years as follows: 0.3 staff years by NRR to develop the PTA. 7.0 staff years by the regions to conduct'and document the fire barrier inspections. 0.7 staff years by NRR to assist in resolving regional inspections findings and_to assist in tracking plant-specific issues identified in the NRR special review team final report and other sources. Completion date: May 1995 (WITS Control No. 9200190). Status: Completion date and resources unchanged. The TI was drafted and is currently undergoing internal review. The staff also witnessed ampacity derating tests performed by Tennessee Valley Authority for Watts Bar Nuclear; performed a vendor inspection at Omega Point Laboratories; and completed several plant-specific tasks. PART IV ASSESSMENT OF NRC'S FIRE PROTECTION PROGRAM' Objective: To address the issues identified through the Commission's review of the DIG report of August 12, 1992; NRR's review of i the report; and the programmatic issues identified in the July 1, 1992 revision of the Thermo-Lag Action Plan. Status: Completed February 27,1992, by report entitled ' Reassessment of the NRC Fire Protection Program." The staff will assess and implement the report recomendations through the FP-TAP and the EQ-TAP. PART V MANAGEMENT /0VERSIGHT Objective: To keep the NRC management informed of current issues, progress, and the status of resolving technical issues, and to disseminate applicable information to the industry and the public. Scope: Track the resolution of tasks in the action plan, add new tasks as appropriate, and update status as necessary. Update the Thermo-Lag Action Plan quarterly and provide to the Commission. Respond to the Comission's concerns on issues raised as a result of the Inspector General's final report of August 12, 1992. Respond to issues identified in 10 CFR 2.206 petitions regarding Thermo-Lag fire barriers. Prepare responses to Congress relating to Thermo-Lag and fire protection issues. Prepare slides and briefing packages for management meetings, public meetings, and briefings. Respond to incoming memoranda, notes, and letters as appropriate, to ensure the guidance and requirements of the NRC fire protection program for fire endurance tests of raceway fire barrier systems are clearly delineated to NUMARC, the industry, technical consultants, and concerned members of the public. Staff effort: 4.5 staff years. Completion date: May 1995. Status: Completion date and resources unchanged. The staff issued the final director's decision on the NIRS 2.206 petition, responded to Congressional budget questions, provided input to the NRC annual report, supported the NRC Regulatory Information Conference, and prepared the Fire Protection Task Action Plan and the first quarterly report to Congress. j Thermo-Lag Task Action Plan June 16, 1993 i i
SUMMARY
OF STAFF RESOURCE REQUIREMENTS f It is estimated that 18.0 staff years will be required to complete the Thermo-Lag Action Plan, which will consist of the following. NRR effort: 11.0 staff yecrs 6 Part I 4.0 staff years Part II 1.0 staff year Part III 1.0 staff year Part IV 0.5 staff year Part V 4.5 staff years Regional effort: 7.0 staff years to complete the inspections, documentation, and enforcement for Part III Region I 1.8 staff years Region II 1.8 staff years Region III 1.8 staff years Region IV 0.8 staff year Region V 0.8 staff year Status: The staff resource estimates have not changed. Some resources will be transferred to the FP-TAP in the next revision the Thermo-Lag Action Plan. ESTIMATED TECHNICAL ASSISTANCE COSTS It is estimated that technical assistance funds in the amount of $368,000 (FY 1992 5243K and FY 1993 $125K) will be required for the National Institute of Standards and Technology (NIST) to assist with the NRC testing program. This includes tests of Thermo-Lag materials and the other fire barrier materials used by reactor licensees. Status: The estimate for the NIST contract for FY 1993 was increased by $25K to account for the cost to test the other fire barrier materials. In consultation with the Chairman of the Investigative Task Force, the costs associated with the full-scale test program were deleted from the Thermo-Lag Action Plan.
