SUBJECT:

REPORT AND STAFF EVALUATION OF THE MARYLAND RADIATION CONTROL PROGRAM Enclosed is the subject report and staff evaluation.

At the time of this program review, comments were offered to the State concerning the need to review the enforcement history of Neutron Products, Inc. (NPI). As a result of an incident in May 1988, the State had issued an ' order to NPI but had failed to follow-up on NPI's compliance with the order. Subsequent to the review, an almost identical incident occurred which indicates that NPI's corrective actions following the first incident were inadequate.

Region I has been working with the State very closely as a result of the second incident. After a number of meetings with the State in which we have discussed our concerns and provided technical assistance, the State has been pursuing aggressive enforcement action against NPI.

It is recommended that an interim visit be conducted in 12 months, h.bh John R. McGrath Regional State Agreements Officer
