• EXPIRATION OF LICENSE The Nuclear Regulatory Commission (NRC) has received a letter dated May 17, 1993, from Duke Power Company, informing us that Duke Power Company no longer has a need to maintain your operating license for the Catawba Nuclear Plant effective May 17, 1993. Therefore, in accordance with 10 CFR 55.55(a), your NRC License No. OP-20772 has expired.

By our letter dated April 23, 1993, you were issued an NRC enforcement action.

e (EA 93-088) which contained a Notice of Violation for violating the provisions of 10 CFR 55.53(j) prohibiting the use of cocaine. That letter required you to respond to the Notice of Violation within 30 days of the date of the letter transmitting the Notice of Violation.

To date, we have not received your response. The purpose of this letter is to inform you that if you reapply for an NRC operating license, you will need to satisfy not only the requirements of 10 CFR 55.31, but also those of 10 CFR 2.201, by addressing the reasons for the violation and the actions you have taken to prevent recurrence in order to ensure your ability and willingness to carry out the special trust and confidence placed in you as a licensed operator and to abide by all fitness-for-duty and other license requirements and conditions. Additionally, you will be required to explain the facts and circumstances related to your arrest on February 28, 1993.

In accordance with Section 2.790 of the NRC's " Rules of Practice," Part 2, Title 10, Code of Federal Regulations, enforcement actions are placed in the NRC Public Document Room (PDR). A copy of our letter dated April 23, 1993, without its enclosure will be placed in the PDR because of your failure to provide a response within the required 30 days. A copy of this letter will also be placed in the PDR as well as in your license docket file. All correspondence made public will have your address removed.
