APPLICATION FOR AMENDMENT TO OPERATlhlG LICENSE The New York Power Authority requests an amendment to the Technical Specifications contained in Appendix A to Facility Operating License DPR-59 for the James A. FitzPatrick Nuclear Power Plant. This application is filed in
< accordance with Section 10 CFR 50.90 of the Nuclear Regulatory Commission's regulation.
This application for an amendment to the James A. FitzPatrick Technical Specifications proposes four changes associated with the FitzPatrick torus (or suppression chamber) LCOs, Surveillance Requirements and associated Bases.
The first of these changes revises LCO 3.7.A to specify minimum and maximum torus water levels in terms of level above the bottom of the torus.
The LCO currently specifies minimum and maximum water levels in terms of downcomer submergence. The proposed change will not affect the actual water levellimits. The second and third changes revise Surveillance Requirement (SR) 4.7.A. The second change permits torus inspections during mid-cycle outages. The SR currently requires periodic inspections "at each refueling outage." The third change clarifies the current requirement that the " pool temperature be continually monitored and also observed and logged every five minutes until the heat addition is terminated." The fourth change includes those revisions proposed to correct editorial errors and clarify terminology.
The proposed changes to the Technical Specifications are Attachment I to this Application for Amendment to the Operating License. The Safety Evaluation for the proposed change is included as Attachment 11. A markup of the affected Technical Specification pages is included as Attachment 111.
