EXEMPTION REQUEST FOR RECEIPT OF FRESH FUEL ASSEMBLIES (TAC NO.
L30565)
Due to a reorganization at the Nuclear Regulatory Commission, we have reformatted your license by combining into one document the safety and

safeguards license conditions, which we are reissuing in total at this time.
Future amendments will include only the applicable portions of the document-being changed (safety or safeguards).
Please note that all previous temporary safeguards conditions have been deleted from your license since they are no longer applicable.

This is in response to your letter, dated June 23, 1993 (your reference 1
- NRC-93-013), in which you requested certain exemptions with respect to the receipt of 252 fuel assemblies from General Electric Company which are to be shipped to your facility for the sole purpose of interim storage prior to i
being shipped.to their final destination.-
We have determined that your request is warranted and that the granting of such request will not adversely affect the common defense and security nor the public health and safety, and is'otherwise in the public interest.
Accordingly, we are issuing new License Conditions S-3, SG-4.1, and SG-4.2 to your License SNM-1107, effective immediately, to read 'as follows:
1 S-3 Notwithstanding the requirements of 10 CFR 20.205(b) to monitor the external surfaces of packaged radioactive material' receipts for radioactive contamination, the licensee is exempted from such requirement relative to nine flatbed trailer shipments of fuel assemblies to' be received (for interim _ storage purposes only) from General Electric Company, as identified by the licensee's letter, dated June 23, 1993 (identification # NRC-93-013); provided the-conditions and commitments in said letter are satisfied. 2 SG-4.1 Notwithstanding certain requirements contained in Section 5.0 of the licensee's Fundamental Nuclear Material Control Plan, the licensee is exempted from physical inventory requirements relative to the material identified in Condition S-3; provided the conditions and commitments contained in the licensee's June 23, 1993 (NRC-93-013) letter are satisfied. This condition shall automatically expire on August 31, 1993.
SG-4.2 Notwithstanding the requirement of Section 6.2.1(a).5 of the licensee's Fundamental Nuclear Material Control Plan to unpackage and perform an item count upon receipt of special nuclear material, the licensee is exempted from such requirement relative to-the material identified in Condition S-3; provided the conditions and commitments contained in the licensee's June 23, 1993 (NRC-93-013) letter are satisfied. This condition shall automatically expire on August 31: 1993.
Enclosed is a copy of the complete License SNM-1107, in the new format which incorporates changes to the Safety and Safeguards Conditions, and the combined Safety and Safeguards Evaluation Report which includes the Categorical Exclusion determination.
