j APPENDIX A NOTICE OF VIOLATION Nebraska'Public Power District-Docket:

50-298 Cooper Nuclear Station Operating License: DPR-46!

l During an NRC inspectionLconducted on May 24-28, 1993, a violation of NRC requirements was identified.

In accordance with the " General Statement of Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2, Appendix C, the violation is listed below:

Inappropriate Emergency Plan Implementina Procedure Technical Specification 6.3.2.C requires that written procedures and i

instructions including applicable checkoff lists shall. be established, implemented, and maintained for emergency conditions involving possible or actual releases of radioactive materials. Criterion' V of Appendix 8, 10 CFR Part 50, " Instructions, Procedures, and Drawings," specifies, in part, that activities affecting quality shall be prescribed by documented instructions, procedures, or drawings'of a type _ appropriate to the-circumstances and shall be accomplished in accordance with these instructions,_

procedures, or drawings. One example of violating this requirement is stated below.

Emergency Plan Implementing Procedure 5.7.16, " Release Rate Determination," specifies the process to determine airborne radioactive release rates under plant emergency conditions.

Contrary to the above, Emergency Plan Implementing Procedure 5.7.16, Revision 16, implemented on May 7, 1993, was inappropriate.to the circumstances because it contained erroneous instructions for determining the noble gas release rates using the primary containment monitor and the drywell curie content in Steps 8.3.5, 8.4.5,- and Attachments 3 and 4.

The licensee had created, then failed to identify,'the' error during the procedure revision process.

This is a Severity Level IV violation (298/9320-01) (Supplement VIII).

Pursuant to the provisions of 10 CFR Part 2.201, Nebraska Public Power District is hereby required to submit a written statement.or explanation to the U.S. Nuclear Regulatory Commission, ATTN: Document Control Desk, Washington, D.C. 20555 with a copy to the Regional Administrator, Region IV, 611 Ryan Plaza Drive, Suite 400, Arlington, Texas 76011, and a copy to the NRC Resident Inspector at the facility that is the subject of this Notice, within 30 days of the date of the letter transmitting this Notice of Violation (Notice). This reply should be clearly marked as a " Reply to a Notice of

Violation" and should include for each violation:

(1) the reason for the violation, or, if contested,: the basis for disputing the violation, (2) the corrective steps that have been taken and the results achieved, (3) the corrective steps that will be taken to avoid further violations, and (4) the

date when full compliance will be achieved.

If an adequate reply is not received within the time specified in this Notice, an Order or a Demand for P
