s Question 18f.

Identify, for each state, NRC region and total, the number of violations incurred by, and enforcement; actions taken by NRC for each category of materials license, and calculate the rates of such violations and enforcement actions per 100 licensees for each state, NRC region, and total for each of the past five years.

Categories of material licenses should be those used by AEOD in its annual report (see Table A-1, NUREG-1272, Appendix A).

Answer.

The attached tables provide FY 1989-1993 information ou 404 enforcemrant actions taken by NRC categorized by licensee in each state and NRC region.

Categories of material licensees are those used by AE0D.

The NRC enforcement l

action tracking system (EATS) only maintains data on escalated enforcement actions (Severity Level I, II, III).

The EATS lists the severity level of the escalated enforcement action and does not list each specific violation. NRC l

does not have any reliable computer database on non-escalated enforcement actions. Additional enforcement actions taken against general licensees under Agreement State reciprocity are not included in these figures.

These cases are reflected in the answer to Question 24 of the May 4,1993 questions.

Situations in which licensees of Agreement States are allowed to operate in states under NRC jurisdiction, i.e. the reciprocity system provided in 10 CFR 150.20.

ANSWER.

NRC regulations in 10 CFR 150.20 grant each Agreement State licensee a general license to conduct activities authorized by the Agreement State license in areas of NRC jurisdiction. This is referred to as " operating under reciprocity." These licensees may only operate under reciprocity for up to 180 days a year unless they are performing activities in offshore waters.

Licensees operating in offshore waters may continue to do so for an unlimited period of time.

When operating under reciprocity, the Agreement State i

i licensee (NRC general licensee) must comply with the same regulations that are applicable to an NRC licensee performing similar operations under NRC jurisdiction.

They must also comply with all terms and conditions of their Agreement State license unless their license is less restrictive than NRC regulations, in which case they must comply with the NRC regulations.

In general, an Agreement State licensee must submit NRC Form-241, a copy of its Agreement State license, and the required fee to the appropriate NRC Regional Office at least three days before engaging in any activities under

If the licensee is not able.to do so, the NRC Regional Administrator may authorize the licensee to begin the activity by telephone.

In this case, the licensee must file the required documentation three days af ter the telephone notification.

Following receipt of the initial request, the NRC Regional Administrator may waive the requirement to file additional documentation during the remainder of the calendar year.

This does not however, release the licensee from the need to provide information on the dates and location of use to the NRC.

Internal NRC guidance states that every reasonable effort should be made to conduct inspections of Agreement State licensees operating under reciprocity at the same priority as that for an equivalent type NRC license. For example, NRC considers radiography licensees to be of highest priority for inspection.

As a result, NRC would tend to inspect radiography licensees operating under reciprocity more frequently than licensees using portable gauges, which are at a lower NRC inspection priority.

NRC has the regulatory authority to take enforcement action against NRC licensees as well as Agreement State licensees operating under reciprccity.

The type of action is based on the safety and regulatory significance of the f

violation.

It is NRC practice to inform Agreement States of any enforcement action taken against one of their licensees operating under the NRC general

license, i

whether the area is under exclusive Federal jurisdiction or whether the Agreement State has jurisdiction over the area.

If a licensee in an Agreement State desires to perform licensed activities in another Agreement State's jurisdiction, the licensee provides a form similar to the NRC Form 241 and provides payment of fees, if any, to the Agreement l

State regulatory program in which it intends to conduct activities. That Agreement State program will then determine whether the reciprocity licensee will conduct operations within their jurisdiction and whether the reciprocity licensee will be inspected.

The Agreement State will also handle any resulting enforcement actions taken as a result of an inspection.

Enforcement actions taken by Agreement States against their own licensees or licensees under reciprocity are reviewed by the NRC as a part of the routine review of Agreement State programs for adequacy to protect public health and safety and compatibility v'th NRC's regulatory programs. As part of the Agreement State review, states are asked to identify cases and to provido copies of enforcement actions.

This information has not been documented in terms of any reports or data collection mechanisms other than the periodic review, which concludes that the enforcement program is adequate to ensure corrective action that will be taken to protect public health and safety in the Agreement States.
