Niagara Mohawk Power Corporation transmitted an Application for Amendment to Nine Mile Point Unit 2 Operating License NPF-69 on February 27,1993 (NMP2L 1370). The Application for Amendment contained proposed changes to the Technical Specifications set forth in Appendix A of the above mentioned license, specifically Definition 1.9, " Critical Power Ratio," and Section 3/4.3.6, " Control Rod Block Instrumentation". Bases changes to Sections B2.1 and B3/4.2 were also included. Based on conversations with the Nuclear Regulatory Commission Staff, the proposed changes to Section 3/4.3.6, specifically Table j
3.3.6-2, " Control Rod Block Instrumentation Setpoints," are hereby withdrawn.

l The setpoint and allowable value for the Recirculation Flow Upscale Rod Block contained in j
Table 3.3.6-2, " Control Rod Block Instrumentation Set 1*oints," were proposed for revision to facilitate operation at up to 105% rated core flow. The proposed changes would have increased the trip setpoint and allowable values from 108% to 111% and from 111% to 114% of rated core flow, respectively. As stated in the Application for Amendment, the flow unit upscale trip performs no safety function and no design basis transient or accident analysis takes credit for it. That is, there is no safety basis for the setpoint. This conclusion is supported by NUREG 1433, " Improved Standard Technical Specifications," wherein the rod block functions associated with recirculation flow were removed from the Standard Technical Specifications.
In several conversations, the Staff expressed concern regarding the lack of an analytical basis l
for the proposed change to the Recirculation Flow Upscale Rod Block Setpoint. Niagara Mohawk understands the Commission's concern and, after due consideration, has decided to l

The Commission's Project Manager stated that providing instructions directing the Staff to remove portions of the amendment application would be more efficient than submitting a revised application. Therefore, please remove Technical Specification Page 3/4 3-63 from Attachment A of the Application for Amendment and disregard those portions of the discussion in Attachment B dealing with the recirculation flow upscale rod block and increased core flow. Niagara Mohawk will evaluate the necessity of retaining the recirculation flow rod blocks in the Technical Specifications and may propose removal of the rod blocks in a future amendment application.
