NOTICE OF VIOLATION

NRC INSPECTION REPORT 50-528 (529, 530)/93-18

,

During the period of May 3 - 7, 1993, Mr. L. Coblentz and Mr. N. Mamish of

this office conducted an inspection of your Palo Verde Nuclear Generating

Station. At the conclusion of the inspection, Mr. _Coblentz and Mr. Mamish

discussed our findings with members of your staff identified in the enclosed

report. Additional information was sent for the inspectors review ~on May 17,

1993, and this information was reviewed during in-office inspection. from May.

18 - 21, 1993. The findings of the in-office inspection were communicated to--

Mr. P..Hughes and other members of your staff during telephone conversations

from May 24 - June 1, 1993.

Areas examined during this inspection are described in the enclosed report.

Within these areas, .the inspection consisted of selective examination of'

/

procedures and representative records, interviews with personnel, independent.

measurements, and observations of activities in ' progress.

Based on the results of this inspection, certain of your activities appear-to

be in violation of NRC requirements, as specified in the enclosed Notice of.

Violation (Notice). Your control of radioactive material appears to ' warrant-

additional management attention, as evidenced.by three instances of failure to

survey as necessary to prevent the unauthorized disposal. of radioactive -

material.

In addition, we noted two instances of failure to follow procedures

related to (1) reporting radiological controls problems, and (2) restricting

,

the use of material marked for radiologically controlled use.

You are required to respond to' this letter and'should follow the instructions'

specified in the enclosed Notice when preparing your response.

In your

response, you should document the specific actions taken and any additional.

actions you plan to prevent recurrence. .After reviewing your' response.to this

Notice, including your proposed corrective actions and the results of future

inspections, the NRC will determine whether further NRC enforcement action.is

necessary to ensure compliance with:NRC regulatory requirements;-

Additionally, two violations discussed in the enclosed report are'not being _

cited because- the. criteria of Section VII of the NRC Enforcement. Policy were

The responses directed by this letter and the enclosed Notice are not subject

to the clearance procedures of the Office of Management and Budget as required

by the Paperwork Reduction Act of 1980, Pub. L.96-511.
