- 1. Essig) participated in a discussion panel for the technical sessions involving implementation issues for the new Part 20 at the Health Physics Society Southeastern Regional Workshop, " Implementation of HRC's New Part 20:
Questions and Answers, Problems and Solutions," held at NIST in Gaithersburg j
on May 27-28, 1993. The workshop was sponsored by the Baltimore-Washington Chapter of the Health Physics Society.
j Environmental Qualification On May 28, 1993, A. Thadani, G. Hubbard, and M. Callahan brief ad staff members of the House of Representatives Mining and Energy Subcommittee on environmental qualification (10 CFR 50.49) issues. The major focus of the briefing was Information Notice 92-81:
Potential Deficiency of Electrical Cables With Bonded Hypalon Jackets.
BWR Water level On May 28, 1993, the staff issued NRC Bulletin 93-03, " Resolution of issues Related to Reactor Vessel Water Level Instrumentation in BWRs." This bulletin was issued on an expedited basis, and requested that BWR licensees implement short term compensatory actions and operator training to ensure that potential level errors due to noncondensible gas are promptly recognized and appropriate actions are taken during transient and accident scenarios initiated from reduced pressure conditions (Mode 3). The bulletin also requested each BWR licensee to implement hardware modifications at the next cold shutdown beginning after JC y 30, 1993, or prior to starting up, if a facility is in cold shutdown on July 30, 1993.
l The staff briefed the Commissio an this issue on Tuesday, June 1, 1993. Also making presentations to the Commission at that briefing were the BWR Owners' Group and Mr. Paul Blanch, a public participant.
Indian Point 3 The unit has been shutdown since february 26, 1993, for the " Performance Improvement Plan" outage. The licensee's latest schedule has plant restart no sooner than August 1993. A Special Team Inspection exit briefing was l
conducted by Region I on June 1, 1993, and is discussed in Enclosure R.
Salem Nuclear Generatina Station. Units 1 and 2 Salem 2 has experienced problems in the rod control system during the restart from the seventh refueling outage.
Intermittent problems with group and individual rod position indication have repeatedly forced the plant to shut JUNE 4. 1993 ENCLOSURE A 1

down.
The licensee has formed a Significant Event Response Team to determine i
the root cause of the rod control problems.
Following completion of the licensee's investigation, a conference call with the NRC staff to discuss the

problems and solutions will be held.
Salem 1 continues to operate at 100%
power with no significant problems.
A phone call between the licensee and the staff was held on May 27, 1993, to discuss the licensee's plans for resolving the open issues as a result of the
)
i fire protection inspection that was conducted during May 17 thru May 21. The i
more significant issues include the adequacy of the 3M fire barrier material, the ability of the licensee to implement the alternate shutdown procedure from t
outside the control room and emergency lighting.
The licensee was unable to provide a schedule for completion of these items. A follow-up phone call will i

t Pronosed Amendments to Uranium Mill Tailinas Standards i
On May 28, 1993, Administrator Browner of the Environmental Protection Agency j
(EPA) approved proposed amendments to EPA's environmental standards for uranium mill tailings disposal in 40 CFR Part 192. The amendments should be published in the Federal Reaister within a few weeks.
EPA initiated these amendments as part of its efforts to eliminate unnecessarily duplicative regulations by rescinding Clean Air Act standards in Subpart T of 40 CFR i
Part 61.
In 1990, the Nuclear Regulatory Commission petitioned EPA to reconsider the Subpart T standards, along with standards in Subparts I'and W, i
on the basis that they were unnecessary because the regulatory programs of NRC and the Agreement States were already providing sufficient protection to the public and environment from air emissions of radionuclides from licensed facilities.
EPA's schedule in proposing the amendments to Part 192 was driven
[
by the October 1991 staff level Memorandum of Understanding on Subparts T and W between 14RC, EPA, and the States of Colorado, Texas, and Washington, and l
the settlement agreement between EPA, American Mining Congress, Natural Resources Defense Council, Environmental Defense Fund, and private uranium q
mill owners.
In accordance with the Commission's agreement in principle with the terms of the settlement P.greement in January 1993, the staff will i
expeditiously develop for Ccmmission review draft proposed conforming amendments to Appendix A of 10 CFR Part 40 by August 1993.

Update on a SDMP Site-Molvcorp On May 27, 1993, Nuclear Regulatory Commission staff approved the Molycorp, Inc., " Plan for The Closure Of Eight Surface Impoundments At Molycorp's Washington, Pennsylvania Facility" subject to a small number of comments.
However, in implementing the plan, Molycorp must first demonstrate:
(1) that proposed discharges to the sanitary sewer comply with applicable requirements of 10 CFR Part 20; and (2) the accura,c.y of the scintillometer probe calibration used to measure average 2 'Th concentration in a 55-gallon drum, or other suitable container. Molycorp is also seeking approval of the plan by i
the Pennsylvania Department of Environmental Resources (PA-DER).
j Molycorp developed the closure plan in response to a PA-DER directive that the impoundments be closed because they did not satisfy Resources Conservation and Recovery Act requirements for the storage of hazardous materials. The eight surface impoundments were installed in the late 1960s for the purpose of storing hazardous chemical materials.
Each impoundment holds approximately 40,000 gallons of liquid material and from 7 to 80 tons of sludge.
The contents of these impoundments may also contain radiological contamination.
Molycorp plans on developing a decommissioning plan for the site after the closure of these impoundments and expects to complete the closure of these l
impoundments by the end of 1993.

2 Workshop on Revised Part 20 On May 25, 1993, staff from the Division of Industrial and Medical Nuclear Safety, NMSS, Division of fuel Cycle Safety and Safeguards, NMSS, and.
Division o'
'gulatory Applications, RES, attended a workshop. sponsored by representat is of the uranium industry to discuss implementation of the revised 10 LtR Part 20. Various fuel cycle licensees presented an overview of their plans to implement the revised Part-20. The Nuclear Regulatory Commission staff responded to questions raised by the licensees regarding various technical / health physics issues.
Siemens Power Corporation Siemens Power Corporation (SPC)- has notified the Nuclear Regulatory Commission of plans to build a new facility at its Richland plant to house an expanded dry conversion process. SPC currently uses three ammonium diuranate (ADU) lines to convert uranium hexafluoride to uranium dioxide. The new facility j
will eventually house three dry conversion lines with a nominal capacity of i'
400 MTV (metric ton of uranium)/ year per line.
The expansion is on a tentative three year schedule. SPC has also requested an amendment to their special nuclear material license to allow unrestricted sale of hydrofluoric (HF) acid, condensed from the dry conversion off-gases from the existing test.
line, as well as from the new lines. This HF acid has approximately 1 part per million (3 pCi/ml) of low-enriched uranium, and SPC anticipates generating 0.8 million liters annually from two dry conversion lines.
SPC has requested that NRC authorize release limits for the HF acid.
j Site Visits to Department of Enerov Enrichment Plants During the week of May 24, 1993, a staff member from the Enrichment Branch, Division of Fuel Cycle Safety and Safeguards, observed the Department of Energy's Office of Nuclear Safety perform a nuclear criticality safety assessment of the highly enriched uranium area at the Portsmouth Gaseous Diffusion Plant operated by Martin Marietta.
Also, a member of the Enrichment Branch observed a full-participation emergency drill at Paducah Gaseous Diffusion Plant (PGDP) on May 26, 1993.
The drill tested the response capabilities of PGDP's emergency response organization, as well as federal, state and local agencies.
l These site visits are part of the staff's effort to familiarize itself with technica' aspects of the enrichment plants prior to assuming regulatory jurisdiction.
l Yucca Mountain Site Visit l
On May 25-26, 1993, Division of High-Level Waste Management technical staff participated in a site visit to the Yucca Mountain candidate repository site i
to observe and discuss Department of Energy (DOE) site characterization progress in the assessment of Quaternary faulting, exploratory studies facility (ESF) excavation and mapping, and studies of recent earthquakes near Yucca Mountain.

studies of faults located in and near the repository block.
P'articipants-f observed evidence of faulting'in trenches excavated across' faults and heard presentations by investigators responsible for trenching studies. The site visit also included a stop at the north portal of the ESF where DOE has begun e
preparation of a launching chamber for a tunnel boring machine to be used to
[
excavate subsurface testing facilities to characterize the proposed repository.
At the north portal site participants entered the excavation l
(approximately 100 feet into Exile Hill) and observed the progress of ESF work-and were provided a demonstration of a photogrammetric technique to support geologic mapping of features within the excavation.
Audit of the Defense Waste Processino Facility (DWPF)
During May 3-7 and May 24-28, 1993, quality assurance (QA) staff of the i
Division of High-level Waste Management'(HLWM) and the Center for Nuclear e
Waste Regulatory Analyses (CNWRA) observed a Department of Energy (DOE),
Office of Waste Management, Vitrification Projects Division QA audit of the
-l Savannah River DWPF at the Savannah River Plant, South Carolina. The audit was also observed by representatives from the DOE Office of-Civilian i
Radioactive Waste Management Office of QA. The State of Nevada did not
(
participate in this audit. The audit evaluated the adequacy and effectiveness-l of implementation of the DOE Savannah River Operations Office Defense Waste Processing Division (D0E/DWPD) and Westinghouse Savannah River Company (WSRC)
QA Program Descriptions as applied to the waste acceptance activities associated with the high-level waste from production at the DWPF.
r The HLWM and CNWRA observers determined that in general, the audit was effective and the implementation of the DOE /DWPD and WSRC QA programs was adequate for the programmatic areas that were audited.
As a result of the 3
audit, seven preliminary Deviation Corrective Action Requests (DCARs) were issued. The adverse conditions identified in the DCARs do not appear to be' significant in terms of the overall DWPF QA program as implemented by' 00E/DWPD 1
and WSRC.
Denartment of Eneroy Awards Contract for Tunnel Borina Machine On Thursday, May 27, 1993, the Department of Energy (DOE) Yucca Mountain Project Office (YMP) awarded a contract to design and manufacture a tunnel boring machine (TBM) to Construction Tunneling Services, Inc. at a cost of 512.8 million.
The TBM will be used to excavate the subsurface exploratory studies facilities (ESF) at Yucca Mountain. The delivery date for the TBM is mid-March 1994, and the TBM is expected to be operational at the ESF north portal approximately April 15, 1994. The contractor and the YMP are currently investigating features to mitigate grease and oil leakage from the TBM to the underground facilities. The TBM will be capable of boring a tunnel 25 feet in diameter at an approximate speed of 8 feet per hour.

4-the aftershock zone of events that cr.urred on May 16-17, 1993, and, like those events, had a shallow focal depth of approximately 5 kilometers. _ As a result of reanalysis of data from the May 16-17, 1993, earthquakes, the magnitude estimate for the largest of those events has been revised from 4.0 to 3.3.
No information on whether there were any effects noted at the Yucca Mountain site is available at this time.

conclusions: 1) Regulatory guide endorsement should proceed for NQA-1-and NQA-2 (1989 Edition with latest published addenda), including NQA-2 Part.2.7 on l
software QA; 2) There is a need to establish internal procedures for staff participation on NQA standards committees; 3) RES/DE will support NRR in a.

Atmospheric Dispersion and Deposition On May 24, 25, and 26, 1993 PRAB met with members of the European CEC i
(Commission of the European Committees) to complete the formal expert elicitation of U.S. and European experts in the areas of atmospheric dispersion and deposition.
The 16 experts that were elicited-had previously l
met in Rotterdam in April at which time they were informed as to the types of i
information that they would be requested to present. All 16 experts gave individual presentations to explain their rationales and were then also j
subjected to individual elicitation. The data received from these experts will be processed in the next few months and a report will be prepared that l
fully describes the technical process and bases for further elicitation on the l
MACCS and COSYMA consequence codes, j

IRB staff has also been invited to-serve as a Reporter at the Paris session to discuss the consolidated experiences of the 17 participating nations with respect to monitoring during emergency situations.

August 3-5, 1993 has been agreed upon as the date for conducting the risk assessment of.the Region 11 Local Area Network. A security awareness training session was requested and will be presented.

J Federal Procurement Fair and Conference On June 3,1993, Von Deloatch from SBCR and Elinor Cunningham from DCPM participated, along with individuals representing sixty-four other governmental agencies, in a Federal Procurement fair and Conference convened by Congresswoman Eleanor Holmes Norton.
i This was the first such event held and it focused on providing the District of Columbia's small businesses with expanded opportunities for doing business l
with the federal government, and to give federal agencies the opportunity to broaden their procurement resource bases. Approximately 1000 small businesses j
and prime contractors attended.
The Honorable Federico Pena, Secretary of Transportation was the keynote speaker for the event.
Secretary Pena highlighted several new efforts l
underway at the Department of Transportation designed to assist small i
f businesses. He also emphasized the President's strong commitment to the country's small businesses.

A Notice of Violation and Proposed Imposition of Civil Penalties in the amount of 56,250 was issued on June 1, 1993, to Wayne General Hospital, Wayne, 1
New Jersey. This action is based on two Severity Level III violations The l
first violation involved a substantial f ailure to implement the Quality Management Program, as required by 10 CFR 35.32, in that written directives signed and dated by the authorized user were not prepared prior to administration of certain radioactive materials to patients. The second level i
III problem was an aggregate of twelve violations (individually level IV and V) of the radiation safety program which collectively represent a breakdown in
{
the control of licensed activities.
The base civil penalty for a Severity 1
Level 111 violation for this licensee is 52,500.
For the first violation, while a basis existed for a 50X escalation of the penalty because the l
violation was identified by the NRC, and 50% escalation based on prior opportunity to prevent the violation, a basis also existed for a 50%
j mitigation because of the licensee's prompt and comprehensive corrective actions.
Therefore, on balance, 50% escalation of the base civil penalty is
{
warranted.
Accordingly, a civil penalty of 53,750 for the first violation is i
proposed.
For the second problem, the base civil penalty was escalated 50%
based on NRC identification and mitigated 50% based on licensee's prompt and
(
comprehensive corrective actions, resulting in no adjustment to the base civil penalty. Hence, a civil penalty of $2,500 is proposed.
This results in a i
cumulative penalty of 56,250.

An imposition of Civil Penalty in the amount of 51,250 was issued on June 2, l

calibrator when the accuracy and constancy error exceeded 10 percent, and j
(3) administering doses of iodine-131 to patients even though the dose as j

Three Mile Island Security Inspection A security inspection was conducted at Three Mile Island during the week of May 17, 1993, to review the potential regulatory issues stemming from f
the Incident Investigation Team review of the February 7,1993, vehicle intrusion into the site protected area. The inspection was limited to the licensee's compliance with the NRC-approved Security and Contingency plans and other applicable regulatory requirements. Weaknesses were identified in the local law enforcement response and the' licensee's i
response strategy; however, no violations were identified.
The inspection results were presented to the licensee in an exit meeting on May 28, 1993, which was attended by representatives of the i
Pennsylvania Department of Environmental Resources and the Region I Director, DRSS.
An inspection of the Emergency Planning aspects of the incident will be conducted the week of June 7,1993.

On June 1, 1993, the Special Team Inspection (STI) conducted by the Region 1 office held a public exit meeting at the Indian Point 3 site.
The exit meeting was well attended by members of the public and the.

media.
The purpose of the STI was to identify root causes'for the Indian Point 3 performance decline, assess the licensee's effectiveness.
f in identifying and resolving problems, and to identify any additional restart issues. The STI, which started on April 26,-1993, and ended on May 28, 1993, assessed the following:
(1) Management / Organization (including both the site and corporate office); (2) Self-Assessment / Quality Programs; and (3) Functional Area Assessment for the Auxiliary Feedwater and Service Water Systems (operations, maintenance / surveillance, and engineering /technica1' support. The major STI conclusions were:
- Weak Management Processes and Controls Exist
- Weak Management Skills and Vigor Exist
- Weak Independent Oversight Exists i
The STI also identified 10 additional restart issues. The exit meeting concluded with a public question and answer period.
NYPA management agreed with all findings presented. The unit will not i
restart until both NYPA and the NRC agree that it can be restarted and-j operated safely.

The exercise involved a simulated reactor accident and tested reactor safety and protective measure functions. The exercise was developed and controlled by representatives from the Idaho National Engineering Laboratory.

purpose of the visit was for a site tour, a meeting with the licensee on Fermi performance, and an exit meeting for the special inspection on independent verification. This also included a meeting with over 200 personnel on site representing all departments to express concern over recent declining personnel in performance at the Fermi plant.
Subsequent feedback response from the licensee was positive.

Martin, Regional Administrator, Region Ill, members of the Region 111 staff, and Commonwealth Edison Company (CECO) Dresden Station management.
The purpose of the meeting was'to review Dresden Station's performance during the previous month and included discussions on the completed Unit 2 refuel outage and the Unit 3 forced outage.
The licensee presented information on work accomplishments to date and expected activities over the next operating cycle.

Quad Cities Station On June 2, 1993, an enforcement conference was held between Mr. J. B.
Martin, Regional Administrator, Region 111, members of the Region Ill J
staff, and Commonwealth Edison Company (CECO) management regarding Quad Cities emergency diesel generator (EDG) deficiencies.
Since initial i
construction, the swing EDG would not respond properly to all design basis events.
In addition, during the last operating cycle, the Unit 2 EDG was degraded due to cooling water pump bearing problems.
