SUBJECT: NRC INSPECTION REPORT 50-458/93-09

This refers to the special fire protection team inspection conducted by-
Mr. A. Singh and the inspectors identified in the attached report on March 29
through April 22, 1993. The inspection included a review of activities
authorized for your River Bend Station facility. At the conclusion of the
onsite inspection on April 2, 1993, the findings were discussed with those
members of your staff identified in the attached report. Additional
information was provided to and reviewed by the NRC team after the onsite

portion of the inspection. Telephone conversations were held with-

Mr. Hamilton and others of your staff cnd Mr. Constable and others of our
-
staff to clarify certain issues on April 16, 22, and 27,1993.
Areas examined during the inspection are identified in the report. They
l
included an evaluation of your corrective actions on previously identified
,
fire protection findings and included an assessment of the plant staff's
ability to achieve and maintain post-fire safe shutdown. Within these areas,
the inspection consisted of selective examinations of procedures and
representative records, interviews with personnel, and observations of
activities in progress. The purpose of the inspection was to determine
whether activities authorized by the license were conducted safely and in
accordance with NRC' requirements.
Based on the results of this inspection, an apparent violation was identified
and is being considered for escalated enforcement action in accordance with
the " General Statement of Policy and Procedure for NRC Enforcement Actions"
(Enforcement Policy), 10 CFR Part 2, Appendix C.
This issue involves your
failure to have completed an associated circuits analysis as required by
-Section III G of 10 CFR Part 50, Appendix R ano your tailure to have an
r
independent contractor provide fully detailed documentation of the design
bases and assumptions supporting conclusions in your fire hazards analysis as
comitted to in a letter dated May 7,1990, in response to a previous
viol ation. This failure to comply with the basic regulation and to take

suitable corrective action for a previous violation is of cucern because it
,
indicates a weakness in your corrective actions in the area of fire protection
over an extended period of time.

Accordingly, no Notice of Violation is presently being issued for these

inspection findings.
In addition, please be advised that the number and
~
characterization of the apparent violation described in the enclosed
inspection report may change as a result of further NRC review.

An enforcement conference to discuss this apparent violation has been
i
scheduled for 10 a.m., June 4,1993, in the Region IV office. The decision'to
hold an enforcement conference does not mean that~ the NRC has determined that
a violation has occurred or that enforcement action will be taken. The-
purposes of this conference are to discuss the apparent violation, its cause
.
and safety significance;'to provide you the opportunity to point out any'
i
_
errors in our inspection report; and to provide an opportunity for you to
present your proposed corrective action.
In particular, we expect you'to
address your schedule for completing corrective action related to this issue.
This is an opportunity for you to provide any information concerning your
perspectives on (1) the severity of the violation, (2) the application of the
factors that the NRC considers when it determines the amount of a civil
.
penalty that may be assessed in accordance with Section VI.B.2 of the
!
Enforcement Policy, and (3) any other application of the Enforcement Policy to
f
this case, including the exercise of discretion in accordance with
-i
Section VII. You will be advised by separate correspondence of the results of
!
our deliberations on this matter. "No response regarding the' apparent
i
violation is required at this time.

In addition to the above,. please plan to discuss the status. and schedule for
{
completion of other remaining corrective actions in the fire protection area
t
including your assessment of the reasons for the extended' period of time-
needed to resolve fire protection issues at River Bend Station. Generic .
!
issues that are being resolved on an industry wide basis need not be included
in this discussion.
In accordance with 10 CFR Part 2.790 of the NRC's " Rules of Practice," a copy

of this letter and its enclosure will be placed in the NRC Public Document
Room.
