Dear Congressman Gallo:

During the Subcommittee on Energy and Water Development's April 22, 1993 hearing on the Nuclear Regulatory Commission's FY94 appropriations, you expressed concern regarding the licensing of Envirocare of Utah, Inc., to provide a disposal location for uranium and thorium waste located on your constituents' properties. We share your frustrations about this licensing action. However, the NRC cannot grant a license to Envirocare until such time as the company has demonstrated that its application to construct and operate a facility to receive, store, and dispose of such byproduct material complies with all applicable NRC regulations.

Such regulations are intended to ensure that the public health and safety and the environment are adequately protected.

We have been vigorously pursuing resolution of issues that have impeded progress in the Envirocare licensing review. On December 21, 1992, the Executive Director for Operations and the Director of the Office of Nuclear Material Safety and Safeguards personally met with the applicant to convey NRC's concerns with the applicant's slow progress.

After the meeting, a realistic review schedule, revised to reflect Envirocare's past performance, was transmitted to Envirocare.

This schedule showed that, assuming all the stated milestones were adequately met, the NRC would issue Envirocare a license on November 1, 1993.

Two major milestones identified in the schedule have been achieved this year.

On January 25, 1993, NRC issued the Draft Safety Evaluation Report (DSER),

which documents the staff's review of the license application and its conclusions about the applicant's compliance with the appropriate regulations.

As a result of the staff's review, the DSER identified 87 open issues that the applicant must resolve before the NRC can license the facility.

Envirocare's response to the DSER open issues was received on April 5, 1993, and the staff is currently reviewing this information. However, this submittal was received 2 weeks later than the scheduled date of March 22, 1993.

As a result, a revised schedule (enclosed) was issued on April 15, 1993, projecting issuance of the license by November 15, 1993.

The NRC also issued a Draft Environmental Impact Statement (DEIS) in February 1993. The DEIS has been filed with the U.S. Environmental Protection Agency (EPA), and a Notice of Availability was published in the Federal Reaister on March 12,1993. The mandatory 45-day public comment period for the DEIS began on March 12, 1993, and ended on April 26, 1993.
