SUBJECT: NOTICE OF VIOLATION (NRC REGION I INSPECTION NO. 50-333/93-06) This refers to the results of the routine resident safety inspection conducted by Messrs. W. Cook, J. Tappert, and others from March 7,1993 to April 17, 1993. The inspectica included a review of activities authorized for your James A. FitzPatrick facility. At the conclusion of the inspection, the findings were discussed with you and members of your staff. Areas examined during the inspection are identified in the report. Within these areas, the inspection consisted of observation of activities, interviews with personnel, and document reviews. The purpose of the inspection was to determine whether activities authorized by the licensee were conducted safely and in accordance with NRC requirements. Based on the results of this inspection, certain of your activities appeared to be in violation of NRC requirements, as specified in the enclosed Notice of Violation (Notice). During our followup of your leaking recirculation piping decontamination connection, we identified that the post-modification installation testing prescribed in the modification package was not executed as required. This procedural noncompliance was of minor safety consequence, however, it was one of several problems identified during the review of this modification. We also noted that some of the information provided to the NRC in your Licensee Event Report 93-06, dated March 12, 1993, was inaccurate. Although this noncompliance with requirements for submitting accurate information was of minimal safety significance, incomplete and inaccurate submittals by your staff have been the subject of previous enforcement action and your corrective actions warrant strengthening. You are required to respond to this letter and should follow the instructions specified in the enclosed Notice when preparing your response. In your response, you should document the specific actions taken and any additional actions you plan to prevent recurrence. After reviewing your response to this Notice, including your proposed corrective actions and the results of future inspections, the NRC will determine whether further NRC enforcement action is necessary to ensure compliance with NRC regulatory requirements.
