Gentlemen:

The. enclosed resolution was passed unanim'ously at a meeting held by the civic assocation on May 6, 1990.

It is our hope that you will fulfill your obligation to dredge the soudt branch of the river, the south side of the river, and the adjacent lagoons, now that the courts have affirmed the rights of the riparian owner, Mr. Pearl.

This project has been delayed for almost five years, and boat and property owners find it extremely difficult to navigate at low tide. Swimming, because of the depth of silt, is an unpleasant', and almost impossible accomplishment from the water-front-properties.

We would appreciate your prompt consideration of this request.

Please advise us as to your plans so that we may inform our membership.

E WHEREAS, the Forked River, then the south branch of t orEed River serves as the intake canal for the Oyster Creek Nuclear Pbwer' Plant; and WHEREAS, severe shoaling of the Forked River, the south branch of the ,

- Forked River, and it's adjacent lagoons has ocurred as a result of the L continual force of the intake of water from Barnegat Bay; and -

t- l WHEREAS, this shoaling has ruined the recreational value of waterfront properties of homeowners living in Forked River Beach by impeding L

L navigation and swimming; and {

WHEREAS, on four occasions during the winter of 1990, the Oyster Creek [

Nuclear Power Plant has shut down due to an insufficient flow of water l traversing the south branch of th, Forked River; and  :

+ WHEREAS, a recent court decision affirms the r'ights of primary riparian [

owner, Mr. Charles Pearl; and NOW, HEREFORE BE IT RESOLVED BY the Forked River Civic Association, that JCP&L take~ measures-to remediate the shoaling of the south branch of the Forked River, it's adjacent lagoons and the south side of the ~,

Forked River leading to Barnegat Bay; [

BE IT FURTHER RESOLVED that copies of this resolution be sent to: ,

-NJDEP, NRC, Army Corp of Engineers, US Dept.-of Energy, NJ BPU, ,

and the Township of Lacey, as well as Senator Leonard Connors, Assemblyman Jeffrey Moran, and Assemblyman Christopher Connors, and the media.
